<br />ORDINANCE NO. 200o-00q <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, <br />PARIS, TEXAS, AMENDING SECTION 29-82 OF THE CODE OF <br />ORDINANCES OF THE CITY OF PARIS, PARIS, TEXAS, RELATED TO <br />THE USE OF MARKET SQUARE; PROVIDING A SEVERABILITY <br />CLAUSE; PROVIDING A REPEALER; MAKING OTHER FINDINGS AND <br />PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />WHEREAS, the City Council of the City of Paris, Paris, Texas, has considered and approved <br />the use of a portion of the parking property for Market Square for construction of a skate park for <br />recreational purposes for the citizens of the city of Paris; and, <br /> <br />WHEREAS, the City Council desires to clarifY existing ordinances related to the use of the <br />Market Square property; and, <br /> <br />WHEREAS, the City Council deems it appropriate to expand the authorized use of the <br />Market Square property; NOW, THEREFORE, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, <br />TEXAS: <br /> <br />Section 1. That the findings set out in the preamble of this ordinance are hereby in all things <br />approved. <br /> <br />Section 2. That Section 29-82 of the Code of Ordinances of the City of Paris shall be and <br />is hereby amended to read as follows: <br /> <br />"Sec. 29-82. Use of Market Square. <br /> <br />"The Market Square is hereby dedicated to the use of producers of farm, garden, and <br />orchard products, livestock, poultry, eggs, milk, and butter under such regulations as <br />are provided in this division or which may hereafter be provided for by the City <br />Council. This section shall not be construed to limit or otherwise restrict the use of <br />the Market Square property for other purposes by the City, as such purposes shall be <br />designated by the City Council, including the construction and use of recreational <br />projects as the City shall designate." <br /> <br />Section 3. That the sections, paragraphs, sentences, clauses, and phrases of this ordinance <br />are severable, and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be <br />declared unconstitutional or unlawful by the final judgment, order, or decree of any court or <br />administrative agency of competent jurisdiction, such finding of unlawfulness or unconstitutionality <br />shall not effect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this <br />
