<br />charges and expenses incurred against the real estate on which the work was done. <br />After such time, or after an administrative hearing if one is requested by the owner, <br />whichever is later, the Mayor; the City Manager, City Attorney, City Clerk, Code <br />Enforcement Officer, as the Mayor's designee; municipal health authority; or other <br />municipal official designated by the Mayor, shall file a statement with the County <br />Clerk of the expenses incurred in the abatement of the above-described condition, in- <br />cluding administrative fees as described herein, and the City shall have a privileged <br />lien on any lot or lots upon which such expenses were incurred, second only to tax <br />liens and liens for street improvements. The lien statement shall state the name of <br />the owner, if known, and the legal description of the property. A copy of the lien <br />statement filed with the county clerk shall be mailed to the owner, if the owner is <br />known. Said privileged lien shall bear interest at the rate often percent (10%) per <br />annum from the date the work was performed (if the work was performed by the <br />City) or from the date payment therefore was made by the City (if the work was <br />performed by a contractor retained by the City). For any such expenditures and inter- <br />est as aforesaid, suit may be instituted and foreclosure had in the name of the City <br />and the statement so made as aforesaid or a certified copy thereof, shall be prima <br />facie proof of the amounts expended for any such work or improvement. <br /> <br />Sec. ]7-30. Release of Lien. <br /> <br />Upon the payment of the charges described in Section 17-27 and the interest <br />accrued thereon, or such lesser amount as the City Manager shall deem appropriate <br />and in the best interest of the City, the City Manager is authorized to execute on <br />behalf of the City a release of lien in the form approved by the City Attorney. <br /> <br />Sec. ] 7-31. Penalties. <br /> <br />Each individual violation of this article is hereby declared a misdemeanor and <br />upon adjudication of guilt thereof, any person who violates, disobeys, omits, neglects <br />or refuses to comply with or who resists the enforcement of any of the provisions of <br />this article shall be assessed a fine not to exceed $2,000.00 for each offense in <br />accordance with the provisions of Section 1-6 ofthe Code of Ordinances of the City <br />of Paris, Paris, Texas. Each day that a violation is permitted to exist shall be deemed <br />a separate offense for which a separate fine may be assessed." <br /> <br />Section 4. That any person violating any of the provisions of this ordinance shall be guilty <br />of a Misdemeanor and, upon conviction, shall be fined in any sum not to exceed $2,000.00, and each <br />and every day's continuance of any violation of the above-enumerated sections shall constitute and <br />be deemed a separate offense. <br /> <br />Page II of 13 <br />
