Harris, City Attorney <br />SUBJECT: Disannexation Request <br />DATE: January 4, 2017 <br />BACKGROUND: The city has received an application from a citizen, Andrew Preston, <br />requesting the City Council consider disannexing his property at 1210 Cobb Ranch Road from <br />the City of Paris because he does not receive city water or sewer service in that area. This <br />property owner does receive city services such as police, fire and EMS, and sanitation pick up. <br />He states there is one property between his property and the city boundary line that is owned by <br />Etta Klinkerman, and he says she is indifferent on the issue. He recommends her property be <br />disannexed also, but we have not received an application for disannexation from her. No other <br />property owners in the area have filed disannexation applications <br />STATUS OF ISSUE: City staff has received an application for disannexation from the owner of <br />a single property located at 1210 Cobb Ranch Road, Paris, Texas 75462. The application and a <br />map showing the location of the parcel owned by the person requesting disannexation in relation <br />to adjoining properties and the city boundary limit lines are attached hereto. In June 2013, the <br />City Council adopted Policies and Procedures for Annexation/Disannexation, a copy of which is <br />also attached for your review. Because this application is from a single property owner of a <br />single parcel, the application does not appear to meet the City's criteria for considering <br />disannexation (see Policies and Procedures at page 16). <br />The process for disannexing properties from the City of Paris requires two public hearings over a <br />40 -day period preceded by a 30 -day written notice to all property owners being disannexed and <br />notice to Lamar County, School Districts and Railroad Companies. If the City Council directs <br />staff to disannex the parcel, it will take approximately 90 days to completion. <br />BUDGET: N/A <br />RECOMMENDATION: Provide direction to staff. <br />
