ORDINANCE NO. 99-045 AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF PARIS, PARIS, TEXAS, BE AMENDED BY REVISING SECTION 12-87 OF SAID CODE; PERMITTING THE SALE OF FIREWORKS IN NEWLY ANNEXED AREAS WITH A PERMIT; PROVIDING FOR A PENALTY NOT TO EXCEED $2,000.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF JULY 1, 1999. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section 1. That Section 12-87 of the Code of Ordinances of the City of Paris, Paris, Texas, be, and the same is hereby, amended so that such shall read as follows: "Sec. 12-87. Same-Amendments. "The code adopted by section 12-86 is hereby amended as set out in this section: " "Section 2002.3, Public Retail Fireworks Business in Newly Annexed Areas, is added to read as follows: "(a) Within ninety (90) days of the effective date of any annexation of property into the City, public retail fireworks businesses in existence at the time the location of the business is annexed into the City must make application for a permit to operate. If the annexation occurs after January 1 but before July 31, the permit will expire January 2 of the year following the year in which the property was annexed. If the annexation occurs after August 1 but before December 31, the permit will expire on July 5 of the year following the year in which the property was annexed. "(b) Such retail fireworks businesses shall not be exempt from any applicable codes or ordinances of the City of Paris. II " Section 2. Any person violating any of the provisions of this ordinance shall be guilty of a Misdemeanor and, upon conviction, shall be fined in any sum not to exceed $2,000.00, and each and every day's continuance of any violation of the above-enumerated section shall constitute and be deemed a separate offense.
