<br />ORDINANCE NO. <br /> <br />99-045 <br /> <br />AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING THAT <br />THE CODE OF ORDINANCES, CITY OF PARIS, PARIS, TEXAS, BE AMENDED BY <br />REVISING SECTION 12-87 OF SAID CODE; PERMITTING THE SALE OF FIREWORKS <br />IN NEWLY ANNEXED AREAS WITH A PERMIT; PROVIDING FOR A PENALTY NOT <br />TO EXCEED $2,000.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES <br />IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF JULY <br />1, 1999. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: <br /> <br />Section 1. That Section 12-87 of the Code of Ordinances of the City of Paris, Paris, <br />Texas, be, and the same is hereby, amended so that such shall read as follows: <br /> <br />"Sec. 12-87. Same-Amendments. <br /> <br />"The code adopted by section 12-86 is hereby amended as set out in this section: <br /> <br />" <br /> <br />"Section 2002.3, Public Retail Fireworks Business in Newly Annexed Areas, is <br />added to read as follows: <br /> <br />"(a) Within ninety (90) days of the effective date of any annexation of <br />property into the City, public retail fireworks businesses in existence at the <br />time the location of the business is annexed into the City must make <br />application for a permit to operate. If the annexation occurs after January <br />1 but before July 31, the permit will expire January 2 of the year following <br />the year in which the property was annexed. If the annexation occurs after <br />August 1 but before December 31, the permit will expire on July 5 of the <br />year following the year in which the property was annexed. <br /> <br />"(b) Such retail fireworks businesses shall not be exempt from any <br />applicable codes or ordinances of the City of Paris. <br /> <br />II " <br /> <br />Section 2. Any person violating any of the provisions of this ordinance shall be guilty of <br />a Misdemeanor and, upon conviction, shall be fined in any sum not to exceed $2,000.00, and each <br />and every day's continuance of any violation of the above-enumerated section shall constitute and <br />be deemed a separate offense. <br />
