ORDINANCE NO. 99-021 AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF PARIS, BE AMENDED BY REVISING SECTION 23-5 OF SAID CODE; PROVIDING FOR THE PERMITTED CLOSURE OF CITY-OWNED PARKS FOR SPECIAL EVENTS; PROVIDING FOR A PENALTY NOT TO EXCEED $500.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF APRIL 5, 1999. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section 1. That Section 23-5 of the Code of Ordinances of the City of Paris, Paris, Texas, be, and the same is hereby, amended so that such shall read as follows: "Sec. 23-5. Parks closed during certain hours. "(a) All city-owned parks within the corporate limits of the City shall be closed every day from 12:00 midnight until 5:00 a.m., and it shall be unlawful for any person to loiter, idle, wander, stroll, or play in such parks during such period when they are closed. However, if anyone applies for permission to carry out an activity in a park during such hours and the city manager determines that such activity will not create a disturbance or public nuisance, such manager shall have authority to issue a special permit of such activity. "(b) In accordance with Chapter 24, Article II, the Special Events Committee may permit the closure of city-owned parks for events which meet the definition of a Special Event during the hours which the park would normally be open to the public and for such lengths of time as the Committee deems appropriate, depending on the nature of the event." Section 2. Any person violating any of the provisions of this ordinance shall be guilty of a Misdemeanor and, upon conviction, shall be fined in any sum not to exceed $500.00, and each and every day's continuance of any violation of the above-enumerated section shall constitute and be deemed a separate offense. Section 3. All ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. Section 4. This ordinance shall become effective on April 5, 1999.
