<br />ORDINANCE NO. 99-021 <br /> <br />AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING THAT <br />THE CODE OF ORDINANCES, CITY OF PARIS, BE AMENDED BY REVISING <br />SECTION 23-5 OF SAID CODE; PROVIDING FOR THE PERMITTED CLOSURE OF <br />CITY-OWNED PARKS FOR SPECIAL EVENTS; PROVIDING FOR A PENALTY NOT <br />TO EXCEED $500.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES <br />IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF APRIL <br />5, 1999. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: <br /> <br />Section 1. That Section 23-5 of the Code of Ordinances of the City of Paris, Paris, Texas, <br />be, and the same is hereby, amended so that such shall read as follows: <br /> <br />"Sec. 23-5. Parks closed during certain hours. <br /> <br />"(a) All city-owned parks within the corporate limits of the City shall be <br />closed every day from 12:00 midnight until 5:00 a.m., and it shall be unlawful for any <br />person to loiter, idle, wander, stroll, or play in such parks during such period when <br />they are closed. However, if anyone applies for permission to carry out an activity <br />in a park during such hours and the city manager determines that such activity will <br />not create a disturbance or public nuisance, such manager shall have authority to <br />issue a special permit of such activity. <br /> <br />"(b) In accordance with Chapter 24, Article II, the Special Events Committee <br />may permit the closure of city-owned parks for events which meet the definition of <br />a Special Event during the hours which the park would normally be open to the <br />public and for such lengths of time as the Committee deems appropriate, depending <br />on the nature of the event." <br /> <br />Section 2. Any person violating any of the provisions of this ordinance shall be guilty of <br />a Misdemeanor and, upon conviction, shall be fined in any sum not to exceed $500.00, and each <br />and every day's continuance of any violation of the above-enumerated section shall constitute and <br />be deemed a separate offense. <br /> <br />Section 3. All ordinances or parts of ordinances in conflict herewith are hereby expressly <br />repealed. <br /> <br />Section 4. This ordinance shall become effective on April 5, 1999. <br />
