last time he inspected the roof. Water that is on the east side of the <br />building is coming off the high roof and the water is flowing as if someone <br />turned on a faucet to the lower level roof. Robert Talley stated that Mr. <br />Hagey contracted a roofer to reroof that section. Ben Vaughan stated that <br />the south wall lower floor has broken and missing brick, and the door <br />located on the south wall is also unsecure and is open most of the time. <br />Robert Talley further stated that a portion of the roof has dropped a good <br />10 -15 inches, reviewing pictures with commissioners regarding that <br />portion of the building. Arvin Starrett asked will this have to go to BSC or <br />will code order repairs. Mr. Talley stated yes this will have to go to BSC <br />as an order to repair. Mr. Starrett further stated so this is affirmation that <br />we do not have a current ordinance on the books that would allow code <br />enforcement to order repairs to this building without it coming under BSC. <br />Robert Talley stated that he is not sure and would need to look at state <br />law; however, Dale Mayberry is involved which escalates the process. <br />The Fire Marshall has more power to get things done. David Stewart <br />stated so is this going to be another Kenny Kammer approach, if so what <br />then. Robert Talley stated this will go to BSC to give owners 30 days to <br />repair, if they do not repair within the 30 days we will move forward to <br />file a court case. Mr. Talley stated that Mr. Hagey is actively trying to sell <br />the building; however, there are two heirs involved who are holding up the <br />sell. Mr. Hagey is glad code enforcement is involved because this may <br />motivate the heirs to sell the building. Ben Vaughan asked what will be <br />required regarding the roof repair, this is not a short term project so do <br />they have 30 days to start or 30 days to complete. Mr. Talley stated he <br />will give the property owners 30 days to start; we will work with the <br />owners as long as they move forward with the repairs. David Stewart <br />asked is there a set of guidelines or approved set of methods to help move <br />the project forward. Mr. Talley stated no there is no quick fix, the roof <br />needs major repair, and they are dumping a lot of water on the neighbor <br />which is also damaging that building. Mr. Starrett stated thank you Robert <br />for your report, but this body is not empowered to take action. No action <br />taken. <br />Further discussion ensued regarding the BSC ordinance, and the fact that it <br />does not empower the Historic Preservation Commission authority to act <br />on structures already designated. <br />7.
