<br />ORDINANCE NO. 2005-058 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, <br />PARIS, TEXAS, AMENDING SECTION 34-28(a)(I) OF THE CODE OF <br />ORDINANCES OF THE CITY OF PARIS, DEALING WITH DEPOSITS TO <br />ENSURE PAYMENT FOR RESIDENTIAL WATER, SEWER, AND <br />GARBAGE SERVICE, TO ALLOW CUSTOMERS TO TRANSFER THEIR <br />DEPOSIT WITHOUT INCREASE FOR CUSTOMERS WHO HAVE <br />MAINTAINED THEIR ACCOUNTS WITHOUT DELINQUENCY FOR THE <br />PERIOD OF TIME THE CITY MAINTAINS BILLING RECORDS ON SUCH <br />DELINQUENCIES, NOT TO EXCEED TEN YEARS; MAKING OTHER <br />FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND <br />PROVIDING AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City Council has previously authorized the increase of deposits for <br />residential customers of City water, sewer, and/or garbage service to cover the cost of account <br />delinquencies; and, <br /> <br />WHEREAS, the City Council desires to allow those customers with good payment history <br />who have not appeared on the City's water cut-off list for the period oftime the City maintains such <br />cut-off records, not to exceed ten years, to transfer their accounts from one location to another <br />location without increase of the amount of the deposit; NOW, THEREFORE, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, <br />TEXAS: <br /> <br />Section 1. That the findings set out in the preamble to this ordinance are hereby in all things <br />approved. <br /> <br />Section 2. That Section 34-28(a)(l) of the Code of Ordinances of the City of Paris, <br />addressing deposits by residential consumers and customers of City water, sewer, and/or garbage <br />service, shall be and is hereby amended to read as follows: <br /> <br />"Sec. 34-28. Deposit to assure payment. <br /> <br />(a) Each purchaser, consumer, or customer of City water, City sewer, or City <br />residential garbage collection service, as such services are provided by the City under <br />its Code of Ordinances, shall, at the time of making application for such water, <br />sewer, or garbage service, make a deposit, with the City, in the following amount: <br /> <br />I. Residential consumers and customers of City water, sewer, and/or <br />garbage service (including transferred accounts), $150; provided, <br />however, those residential consumers and customers who transfer <br />their account to another location within the City who have not <br />
