<br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
<br />TEXAS FORGIVING CERTAIN CIVIL PENALTIES ASSESSED AGAINST
<br />THE PROPERTY LOCATED AT 104 BONHAM STREET; FINDING A
<br />PUBLIC PURPOSE IN SUPPORT OF SAME; MAKING OTHER FINDINGS
<br />AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN
<br />EFFECTIVE DATE.
<br />WHEREAS, on September 19, 2017, after notice, publication and hearing as required by
<br />law, the Building and Standards Commission of the City of Paris ordered and assessed civil
<br />penalties on the property located at 104 Bonham St., otherwise known as the First National
<br />Bank Building, as authorized by the Code of Ordinances of the City of Paris, Chapter 7, Article I11,
<br />Section 7 -49; and
<br />WHEREAS, in a Notice of Order dated September 21, 2016 memorializing the order of
<br />said hearing, a copy of which is attached hereto as Exhibit "A" and incorporated by reference
<br />herein, said civil penalties were assessed in the amount of $100.00 per day to begin accruing on
<br />September 30, 2016; and
<br />WHEREAS, as of February 13, 2017, civil penalties in the amount of $13,700.00 have
<br />accrued under said order, none of which have been paid; and
<br />WHEREAS, pursuant to Code of Ordinances Chapter 7, Article III, Section7- 49(7), civil
<br />penalties shall accrue interenst at the rate of ten (10) a year from the date of assessment until
<br />paid in full; and
<br />WHEREAS, interest on the civil penalties referenced herein from the date of assessment,
<br />September 30, 2016, to February 13, 2017 had accrued in the amount of $510.47; and
<br />WHEREAS, on February 13, 2017, the City council forgave civil penalties and interest
<br />assessed and accrued against the property in the total amount of $14,210.47, after finding a
<br />public purpose to do so; and
<br />WHEREAS, on February 20, 2017, the Building and Standards Commission voted to
<br />vacate its order of September 21, 2016 imposing civil penalties on the property at 104 Bonham
<br />Street; and
<br />WHEREAS, between February 14, 2017 and February 20, 2017, an additional $700.00 in
<br />civil penalties and $2.49 in interest accrued; and
<br />WHEREAS, the First National Bank building is a dangerous structure, to wit: the west
<br />wall facade has detached from the remainder of the building and is at risk of collapse,
<br />endangering the public as well as surrounding properties; and
<br />WHEREAS, the First National Bank building is a historic building, having survived the
<br />great Paris fire of 1916, and is of vital significance and importance to the Paris Plaza and the City
<br />of Paris at large; and
