ORDINANCE NO. 2005-049 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, PURSUANT TO CHAPTER 7 OF THE CITY CHARTER AND SECTION 42.023 OF THE TEXAS LOCAL GOVERNMENT CODE, RELEASING A PORTION OF THE EXTRATERRITORIAL JURISDICTION OF THE CITY OF PARIS, LAMAR COUNTY, TEXAS, THE SAME BEING A TRACT OF LAND FORMING A PORTION OF THE CURRENT OUTER BOUNDARIES OF THE CITY LIMITS OF THE CITY OF PARIS, IN RESPONSE TO A PETITION FOR SUCH RELEASE OF EXTRATERRITORIAL JURISDICTION FILED BY MR. & MRS. JOEL BALL, PROPERTY OWNERS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, Section 42.023 of the Texas Local Government Code authorizes the reduction of the extraterritorial jurisdiction of the City of Paris by formal action of its governing body, subject to the laws of this state; and, WHEREAS, Mr. & Mrs. Joel Ball, property owners, have petitioned the City of Paris to reduce its extraterritorial jurisdiction by releasing property owned by Mr. & Mrs. Ball; and, WHEREAS, the purpose of the aforesaid release of the extraterritorial jurisdiction is to accompany formal disannexation of the same property by the City of Paris, to enable Mr. & Mrs. Ball to obtain sewer service from the City of Reno, Texas, by formal annexation to the City of Reno; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That the City Council does hereby in all things grant and approve a petition seeking relinquishment of extraterritorial jurisdiction, a copy of which is attached hereto and for all purposes incorporated herein as Exhibit A, filed by Mr. & Mrs. Joel Ball, who are at the same time seeking the disannexation of certain property owned by Mr. & Mrs. Ball, as such property for which relinquishment of extraterritorial jurisdiction is sought is described in Exhibit B attached hereto and for all purposes incorporated herein. Section 3. That the property described in Exhibit B is hereby released from the extraterritorial jurisdiction ofthe City of Paris, Lamar County, Texas, and that the boundary limits of the extraterritorial jurisdiction of the City of Paris be, and the same are hereby reduced to release the above-described territory from the extraterritorial jurisdiction of said City.
