Harris, City Attorney <br />SUBJECT: Disannexation Request <br />DATE: June 7, 2017 <br />BACKGROUND: The City has received an application from Jason Boehlar and his wife <br />Whitney Boehlar requesting that the City Council consider disannexing their property at 6055 <br />Clarksville St. because they do not have City water and sewer and the property next to them was <br />disannexed in September 2015 as a part of the "Airport Road disanexations." No other property <br />owners in the area have applied for disannexation. <br />STATUS OF ISSUE: City staff has received an application for disannexation from the owners <br />of a single property located at 6055 Clarksville St. The application and a map showing the <br />location of the parcel owned by the person requesting disannexation in relation to adjoining <br />properties and the city boundary limit lines are attached hereto. In June 2013, the City Council <br />adopted Policies and Procedures for Annexation/Disannexation, a copy of which is also attached <br />for your review. Because this application is from a single property owner of a single parcel, the <br />application does not appear to meet the City's criteria for considering disannexation (see Policies <br />and Procedures at page 16). Council also needs to be mindful of the danger of disannexing so <br />much property in the area that Cox Field becomes effectively landlocked. On the other hand, the <br />adjoining property (Parcel 6059) has already been disannexed, and disannexing the Boehlar <br />property would simply make the total disannexed area a rectangle instead of a flag shape. <br />The process for disannexing properties from the City of Paris requires two public hearings over a <br />40 -day period preceded by a 30 -day written notice to all property owners being disannexed and <br />notice to Lamar County, School Districts and Railroad Companies. If the City Council directs <br />staff to disannex the parcel, it will take approximately 90 days to completion. <br />BUDGET: N/A <br />RECOMMENDATION: Provide direction to staff. <br />
