Has cCllTplied with all pertinent local end state laws, end Texas Recreation & Parks Accoc.Ilt Program <br />(TRPA) requirements regarding public hearings. <br /> <br />2. Has the required proportionate share of funds available and sufficient for the project .s required by <br />Section 13.309 of the Perks & ~ildl ife Code. <br /> <br />3. W'ul .inufo and operate areas acquired or developed with TRPA assistance at sponsor expense .5 <br />required by Seetion 13.309 of the Perks & ~ildlife Code. <br /> <br />4. Will permanently dedicate for public park end recreation use .11 project .rea(l) which receive TRPA <br />assistance, 8S required by Chapter 640.1.2 of TRPA Grants Manual Guidelines. <br /> <br />5. Has the le;al authority to apply for TRPA assistaoce, and the institutional, menageriel and finencf.l <br />capability to ensure proper plaming, mnagement and coopletion of the project described in this <br />appl ication. <br /> <br />6. Will give the SUte of Texas, hereafter referred to as "State", through any authoriz.ed representative, <br />access to and the right to examine all records, books, papers, or docunents related to the asstatence; <br />and will establish a proper accOUltinsl system in accordance with liIenerally accepted ac:cOUlting <br />standards or agency directives. <br /> <br />7. Will not dispose of, modify the use of, or change the terms of the real property title, or other <br />interest in the stte and facilities without penmission and instructions from the Texas Parks & Wildlife <br />Department hereafter referred to as the IIDepartment". Will record the SUte (nterest in the title of <br />real property in accordance with Department directives and will include a covenant In the title of real <br />property acquired in whole or in part with TRPA assistance funds to assure nondiscrimination during the <br />useful life of the project. <br /> <br />8. Will comply with the requirements of the Department with regard to the drafting, review and approval <br />of construction plans and specifications. <br /> <br />9. Will provide and maintain cocrpetent and adequate engineering supervision at the construction site to <br />ensure that the complete work conforms with the approved plans and specifications. <br /> <br />10. Will furnish quarterly progress reports and such other information 8S may be required by the <br />Department. <br /> <br />11. ~ill Initlete end complete the work within the epplicable time frame efter receipt of epproval from the <br />Department. <br /> <br />12. ~ill establish safeguards to prohibit """loyees from using their positions for e p.lrpose thet <br />constitutes or presents the appearance of personal or organizational conflict of interest or personal <br />gain. <br /> <br />13. ~Ill comply with ell Stete end Federel statues relating to non-discrimination. These Include but ere <br />not limited to: (a) Title VI of the Civil Rights Act of 1964 (P.L. 88-352) which prohibits <br />discrimination on the basis of race, color or national origin; (b) Title IX of the Education <br />Aoo<>dments of 1972, eS amended (20 U.S.C. II 1681'1683, end 1685-1686) which prohibits discrimination <br />on the besls of sex; (c) Section 504 of the Rehabilitetion Act of 1973, eS amended (29 U.S.C. I 794) <br />which prohibit discrimination of the besis of hendlceps; (d) the Age ~iscrimination Act of 1975, as <br />emended (42 U.S.C. II 6101-6107) which prohibits discrimination on the besls of age; (e) eny other <br />non-discrimination provisions in the specific statute(s) under which epplicetion for TRPA esslstance <br />is being made, and (f) the requirements of any other non-discrimination statute(s) whlch.may apply to <br />the epplicetion. <br /> <br />14. ~ill comply with the flood insurance purchase requirements of Section 102(a) of the Flood Disaster <br />Protection Act of 1973 (P.L. 93-234) which requires recipients In e special flood hazerd area to <br />participate in the program and to purchase flood insurance if the total cost of insurable construction <br />and acquisition is S10,OOO or more. <br /> <br />(Page 1 of 2) <br /> <br />24 <br />
