<br />RESOLUTION NO. <br /> <br />99-046 <br /> <br />WHEREAS, the City of Paris has actively participated in obtaining grants through the <br />Texas Department of Housing and Community Affairs; and, <br /> <br />WHEREAS, a requirement of the Texas Department of Housing and Community Affairs <br />is that participating cities adopt a resolution establishing rules and regulations regarding the use <br />of excessive force during nonviolent civil rights demonstrations, including physically barring <br />entrance to a facility or location which is the subject of such demonstration, and providing <br />penalties for violations thereof; and, <br /> <br />WHEREAS, it is deemed in the best interests of the citizens of the City of Paris that such <br />policy be established and adopted; NOW, THEREFORE, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the <br />following rules and regulations regarding the use of excessive force during nonviolent civil rights <br />demonstrations, including physically barring entrance to a facility or location which is the subject <br />of such demonstration, and providing penalties for violations thereof in the City of Paris, County <br />of Lamar, State of Texas, be, and the same are hereby, approved: <br /> <br />Section 1. The City of Paris hereby adopts and will enforce this policy prohibiting the use <br />of excessive force by the law enforcement agencies within its jurisdiction against any individual <br />engaged in nonviolent civil rights demonstrations. The City also prohibits the physical barring <br />of any entrance or exit of such a facility and will enforce all applicable state laws regarding same. <br /> <br />Section 2. Any person found to be violating any provision of this resolution shall be <br />served by the City with written notice stating the nature of the violation. <br /> <br />Section 3. Any person guilty of this violation shall be guilty of a misdemeanor and, on <br />conviction thereof, shall be fined in the amount not exceeding one hundred dollars ($100.00) for <br />each violation. Each clay in which any such violation shall continue shall be deemed a separate <br />offense. <br /> <br />Section 4. Any person violating any of the provisions of this resolution shall become <br />liable to the City for any expense, loss, or damage occasioned the City of Paris by reason of such <br />violation. <br /> <br />PASSED AND AOOPTED this 6th day of May, 1999. <br /> <br />C}( !I <br /> <br />(Z..iAa,.r-I.e s <br /> <br /> <br />, Mayor <br />
