RESOLUTION NO. 99-051

WHEREAS, the Texas Department of Transportation, in an effort to provide adequate roads
and bridges suitable for modern traffic, has authorized the necessary funds to construct new bridges
across Cane Creek on FM 1509 in Lamar County; and,

WHEREAS, the Warren trusses onFM 1509 at Cane Creek and FM 1510 at Big Pine Creek
are of historic significance and were listed in the National Register of Historic Places on October 10,
1996; and,

WHEREAS, the need to replace the two National Register-listed Warren trusses has been
justified by a safety and bridge inspection, and it has been determined that the narrow width and low
load rating are contributing factors to unsafe conditions; and,

WHEREAS, the City of Paris desires relocation ofthe historic trusses to Dragon Park in the
City of Paris for re-use as pedestrian bridges; NOW, THEREFORE,

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the City
of Paris hereby commits to preserve the FM 1509 bridge at Cane Creek and the FM 1510 bridge at
Big Pine Creek at Dragon Park in the city of Paris, to retain the bridges' original features and historic
materials, and to prevent any removal from or alterations to the structures that would substantially
change their historic character or appearance; and,

BE IT FURTHER RESOLVED, that the City of Paris hereby commits to retain ownership
of the historic truss bridges and to provide minimal maintenance of the bridges as follows:

1. The deck on the bridges will be maintained to provide continued pedestrian access on
the bridges;

2. Other repairs will be performed on the bridges as needed to accommodate pedestrian
use of the structures;

3. Trash and vegetation will be periodically removed from the bridges;

4. A pathway will be provided to the bridges and maintained to provide the public with
easy accessibility to the historic structures;

5. Signs shall be erected at or near the bridges delineating penalties for vandalism of the
historic facilities;

6.
