<br />INTERLOCAL FIRING RANGE AGREEMENT <br /> <br />STATE OF TEXAS } <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />COUNTY OF LAMAR } <br /> <br />THAT, the CITY OF PARIS, PARIS, TEXAS, a municipal corporation, acting by and <br /> <br />through its Mayor Pro Tem, Mary Ann Fisher, duly authorized, hereinafter called CITY, and <br /> <br />PARIS JUNlOR COLLEGE, acting by and through its President, Bobby Walters, duly authorized, <br /> <br />hereinafter called PJC, do hereby contract and agree as follows: <br /> <br />1. CITY agrees to allow the PJC Law Enforcement Acadamy to use the Paris Police <br />Department Firing Range located at Cox Field Airport in accordance with a schedule <br />approved by the Chief of the Paris Police Department. <br /> <br />2. The schedule is subject to change at any time in the event of any unexpected police <br />operations. <br /> <br />3. CITY has a right to halt activities when the Chief of Police deems any activities or actions <br />to be dangerous. <br /> <br />4. PJC's use of the Police Department Firing Range shall be for official Law Enforcement <br />Acadamy purposes only. <br /> <br />5. PJC will be responsible for its own clean up and will assist in maintenance from time to <br />time. <br /> <br />6. PJC agrees to indemnify, save, keep, and hold harmless CITY from and against any and <br />all demands, debts, liabilities, suits, claims, and causes of action of every kind and <br />character whatsoever for damage or injuries to persons and/or property occurring on the <br />leased premises resulting from PJC's, its members', invitees', agents', servants', or <br />employees' use, and CITY shall not be liable to PJC, its members, invitees, agents, <br />servants, employees, licensees, or visitors due to the buildings or other structures thereon <br />being improperly constructed or being or becoming out of repair, PJC hereby waiving any <br />defects therein and agreeing to hold and save CITY harmless from all claims for any such <br />damages or injuries. <br /> <br />7. <br /> <br />PJC shall and must at all times during the term of this Lease, and any extensions hereof, <br />keep and maintain in full force and effect a policy or policies of insurance, naming CITY <br />as an additional insured, and providing, at least $250,000.00 for each person and <br />$500,000.00 for each single occurrence for bodily injuries or death and $100,000.00 for <br />each single occurrence for injury to or destruction of property, indemnifying all persons <br /> <br />" <br /> <br />EXHIBIT A <br />
