<br />WHEREAS, the City Council of the City of Paris did heretofore, on the 4th day of
<br />December, 1997, in Resolution No. 97-141, award the contract for "Plum Street 1900 Block
<br />Surface Water Runoff Pollution and Flood Mitigation Project," TXDOT Project No. CSJ 0901-29-
<br />905, to Hilliard & Sons Contractors, Inc,; and,
<br />
<br />WHEREAS, the City Council of the City of Paris did heretofore, on the 14th day of
<br />September, 1998, approve Change Order No. One, which said Change Order was incorrect and
<br />should be corrected in the form of Change Order No. One (Corrected), attached hereto as Exhibit
<br />A, which removes the fence and gate from the project, providing for a net decrease of $5,235.00
<br />in the contract price; and,
<br />
<br />WHEREAS, the City Engineer, Earl Smith, acting as project engineer, recommends the
<br />further amendment of the contract for said project in the form of Change Order No. Two, attached
<br />hereto as Exhibit B, which adds rip rap for erosion control, providing for a net increase of
<br />$1,125.00 in the contract price, for a total contract price of $144,560.00; and,
<br />
<br />WHEREAS, the forms of Change Order No. One (Corrected) and Change Order No. Two
<br />and Final, attached hereto as Exhibits A and B, respectively, should, in all things, be approved,
<br />and the Mayor, Charles H. Neeley, should be authorized to execute the same; NOW,
<br />THEREFORE,

<br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the
<br />form of Change Order No. One (Corrected) to the Contract for the "Plum Street 1900 Block
<br />Surface Water Runoff Pollution and Flood Mitigation Project," TXDOT Project No. CSJ 0901-29-
<br />905," attached hereto as Exhibit A, for the removal of fence and gate from the project, providing
<br />for a net decrease of $5,235.00 in the contract price, be, and the same is hereby, approved; and,
<br />
<br />BE IT FURTHER RESOLVED, that the form of Change Order No, Two and Final to
<br />the Contract for said drainage project, attached hereto as Exhibit B, for the addition of rip rap for
<br />erosion control to the project, providing for a net increase of $1,125.00 in the contract price, for
<br />a total contract price of $144,560.00, be, and the same is hereby, approved; and,
<br />
<br />BE IT FURTHER RESOLVED, that the Mayor, Charles H. Neeley be, and he is hereby,
<br />authorized and directed to execute, on behalf of the City of Paris, Change Order No. One
<br />(Corrected) and Change Order No. Two and Final, under the terms and conditions and in the
<br />forms shown in Exhibits A and B, respectively, attached hereto.
