RESOLUTION NO. 2000-155 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, AUTHORIZING THE EXECUTION OF A PURCHASE ORDER FOR A PHYSIO-CONTROL LIFEPAK 12 CARDIAC DEFIBRILLATOR/MONITOR FOR THE EMERGENCY MEDICAL SERVICES DEPARTMENT; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Emergency Medical Services Department of the City of Paris is in need of purchasing a new Physio-Control LifePak 12 Cardiac DefibrillatorlMonitor with External Pacing, 12 Lead ECG, Non-Invasive Blood Pressure, and Oxygen Saturation Monitor with carrying case; and, WHEREAS, Section 252.022(a)(7)(A) of the Local Government Code exempts from the requirement for competitive bidding a procurement of "items that are available from only one source because of patents, copyrights, secret processes, or natural monopolies"; and, WHEREAS, Medtronics Physio-Control Corp. is the sole source providerofPhysio-Control brand products, and, since the EMS currently utilizes other Physio-Control brand equipment, components, and peripherals which are proprietary, with no other brands being compatible therewith, it is deemed appropriate that the EMS purchase such equipment from Medtronics Physio-Control Corp. without the requirement for competitive bidding; and, WHEREAS, it is further deemed appropriate that the City Manager be authorized to execute a purchase order for said defibrillator/monitor for a total purchase price of $19,495.00; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That the City Manager be, and he is hereby, authorized and directed to execute, on behalf of the City of Paris, a purchase order for a new Physio-Control LifePak 12 Cardiac Defibrillator/Monitor with External Pacing, 12 Lead ECG, Non-Invasive Blood Pressure, and Oxygen Saturation Monitor with carrying case for the Emergency Medical Services Department from Medtronics Physio-Control Corp., which is the sole source provider of such equipment, for a total purchase price of $19,495.00. Section 3. That this resolution shall be effective from and after its date of passage.
