<br />Attachment D <br />Standard Provisions and Assurances <br /> <br />SECTION 21.0 AMERICANS WITH DISABILITIES ACT <br /> <br />The Contractor shall comply with all applicable requirements of the Americans with Disabilities Act <br />of 1990,42 U.S.C. Sections 12101 - 12213 (Pamph. 1995). <br /> <br />SECTION 22.0 UTILIZATION OF SMALL, MINORITY, AND WOMEN'S BUSINESS <br />ENTERPRISES <br /> <br />The Contractor agrees that qualified Historically Underutilized Businesses (HUBs) shall have the <br />maximum practicable opportunity to participate in the performance of this Agreement. <br /> <br />SECTION 23.0 ENERGY EFFICIENT STANDARDS <br /> <br />The Contractor is encouraged to follow standards and policies on energy efficiency which are <br />contained in the Texas State Energy Conservation Plan issued in compliance with the Energy <br />Policy and Conservation Act PoL. 94-163). <br /> <br />SECTION 24.0 INDIRECT COSTS <br /> <br />Indirect costs may be authorized in accordance with the procedures established in the UGMS. In <br />accordance with the UGMS, when Contractor has a negotiated agreement signed within the past <br />24 months by a federal cognizant agency or state single audit coordinating agency, the indirect rate <br />authorized in that agreement may be accepted by the ATCOG. Alternatively, the ATCOG may <br />authorize the Contractor to recover up to 10% (percent) of the direct salary and wage costs of <br />providing the service (excluding overtime, shift premiums, and fringe benefits) as indirect costs, <br />subject to adequate documentation. <br /> <br />SECTION 25.0 IMPLEMENTATION PROJECT CATEGORIES AND STANDARDS <br /> <br />The standards and requirements set forth in this Article shall apply to all implementation projects <br />selected for funding under Article 6 of these Program Conditions, and finally funded under this <br />Agreement. The A TCOG shall be responsible for ensuring that the implementation projects funded <br />under this Agreement comply with the standards set forth in the Article. <br /> <br />25.1. ELIGIBLE IMPLEMENTATION FUNDING RECIPIENTS. Only those local and regional <br />political subdivisions located within the State ofTexas as set forth in the Section are eligible <br />to receive funding from the A TCOG as a pass-through grant. <br /> <br />25.1.1.
