<br />24. NOTICES. ASSIGNMENT. <br /> <br />a. Tenant may not assign this Lease or sublet the Premises without the prior written <br />consent of Landlord. <br /> <br />b. Nothing in this Lease shall preclude Landlord from leasing other space for <br />communications equipment to any person or entity which may be in competition with <br />Tenant, or any other party. <br /> <br />26. SUCCESSORS AND ASSIGNS. This Lease shall be binding upon and inure to the benefit ofthe <br />parties, their respective successors, personal representatives, and assigns. <br /> <br />27. NON-WAIVER. Failure of Landlord to insist on strict performance of any of the conditions, <br />covenants, terms or provisions of this Agreement or to exercise any of its rights hereunder shall not <br />waive such rights, but Landlord shall have the rights to enforce such rights at any time and take such <br />action as might be lawful or authorized hereunder, either in law or equity. The receipt of any sum <br />paid or services provided by Tenant to Landlord after a breach of this Agreement shall not be <br />deemed a waiver of such breach unless expressly set forth in writing. <br /> <br />28. TAXES. <br /> <br />a. Tenant shall pay all real and personal property taxes (or payments in lieu of taxes) <br />and assessments for the Premises, if any, which become due and payable during the term of <br />this Lease. All such payments shall be made, and evidence of all such payments shall be <br />provided to Landlord, at least ten (10) days prior to the delinquency date of the payment. <br />Tenant shall pay all taxes on its personal property on the Premises. <br /> <br />Page 13 of 18 <br />
