<br />RESOLUTION NO. 2001-130 <br /> <br />A RESOLUTION OF mE CITY COUNCIL OF mE CITY OF PARIS, <br />PARIS, TEXAS, SETTING A PUBLIC HEARING ON mE <br />EXPANDED SCOPE OF mE PRO RATA SANITARY SEWER <br />EXTENSION FOR mE COPE ADDITION ALONG MEADOWLARK, <br />MOCKINGBIRD, COPE, AND PINE MILL ROAD; MAKING OTHER <br />FINDINGS AND PROVISIONS RELATED TO mE SUBJECT; AND <br />PROVIDING AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City Council of the City of Paris did heretofore on the 12th day of <br />July, 1999, in Resolution No. 99-085 approve the Pro Rata Sanitary Sewer Extension for <br />the Cope Addition along Meadowlark, Mockingbird, Cope and Pine Mill Streets, thence <br />southerly to tie into existing City collection systems, which could be best served by a pro <br />rata sanitary sewer extension, containing 8" P.V.C. sanitary sewer line and appurtenances; <br />and, <br /> <br />WHEREAS, by approving Resolution No. 99-085, the City Council determined it <br />was necessary for the protection of the health and welfare of the Cope Addition along <br />Meadowlark, Mockingbird, Cope, and Pine Mill Streets within the city of Paris for the City <br />of Paris to extend the existing eight inch (8") sanitary sewer line and to act in the capacity <br />of sponsor under the terms of Section IX of Subdivision Ordinance No. 1315 of the City of <br />Paris with any refunds due under the pro rata charges being paid to the City of Paris Water <br />and Sewer Fund; and, <br /> <br />WHEREAS, at the time of approval of Resolution 99-085, the City Council found <br />and determined that upon receipt of the request of the citizens for the aforesaid project, <br />preliminary plans, specifications, and an estimate of the total cost of the project were <br />prepared and delivered to the City Manager and considered at the regular Council Meeting <br />ofthe City of Paris on the 14th day ofJune, 1999, and a public hearing concerning the same <br />was set for the 12th day of July, 1999, at which time such public hearing was held; and, <br /> <br />WHEREAS, after hearing the matters presented at the public hearing, the City <br />Council was of the opinion that it was in the best interest of the citizens of Paris, and <br />particularly the citizens in the vicinity of the proposed project, that the City of Paris act as <br />sponsor for said project which was necessary for providing adequate sewer service and for <br />protecting the health, safety, and welfare in the aforesaid area; and, <br /> <br />WHEREAS, the City Council finds and determines that the prior considerations and <br />determinations by City Council as contained in Resolution No. 99-085 as to the public <br />necessity and need for the aforesaid project have remained unchanged; and, <br /> <br />WHEREAS, the City Council finds and determines that subsequent to the original <br />review of the aforesaid project, it has been determined by engineers on behalf of the City <br />
