<br /> <br />RESOLUTION NO. 2005-073 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, <br />PARIS, TEXAS, APPROVING AND AUTHORIZING A REQUEST TO <br />THE TEXAS DEPARTMENT OF TRANSPORTATION TO CLOSE THE <br />EXISTING CROSSOVER IN THE IMMEDIATE VICINITY OF 34TH <br />STREET NE ON US 82/US 271 (WHICH IS ALSO LOCALLY KNOWN <br />AS LOOP 286) AS A PART OF ITS GRADE SEPARATION OF US 82/ US <br />271 AT PINE MILL ROAD PROJECT; MAKING OTHER FINDINGS <br />AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING <br />AN EFFECTIVE DATE. <br /> <br />WHEREAS, the Intermodal Surface Transportation and Efficiency Act of 1991 (ISTEA) <br />and the Transportation Equity Act for the 21st Century (TEA-2l) codified under Title 23 U.S. <br />Code Section 101 et seq. authorize transportation programs to meet challenges of protecting and <br />enhancing communities, and advancing the nation's economic growth and competitiveness; and <br /> <br />WHEREAS, the Texas Department of Transportation (TxDOT) has received federal <br />Hazard Elimination Safety (HES) Program funding under these Acts to construct a grade <br />separation along US 82/ US 271 (which is also locally known as Loop 286) at Pine Mill Road, <br />within the City of Paris; and <br /> <br />WHEREAS, TxDOT has prepared design work for the construction of said grade <br />separation; and <br /> <br />WHEREAS, the proposed alignments of the travel lanes of US 82 / US 271 and the <br />access ramps on the north end of the proposed grade separation facility all converge in the <br />immediate vicinity of the existing 34th Street NE crossover on US 82/ US 271; and <br /> <br />WHEREAS, this proposed convergence of alignments in the immediate vicinity of the <br />existing 34th Street NE crossover on US 82/ US 271 will become a great safety concern for all <br />traffic in this area due to the potential of crossing traffic conflicting with merging and through <br />traffic in a relatively short distance; and <br /> <br />WHEREAS, both Pine Mill Street (the location of the proposed grade separation project) <br />and 34th Street NE (the location of the expected safety concern should this crossover remain <br />open) are on the City of Paris' roadway system; and <br /> <br />WHEREAS, TxDOT has asked the City of Paris to evaluate the need to retain the <br />existing 34th Street NE crossover on US 82/ US 271, given the previously-cited proposed grade <br />separation safety concerns at this crossover, and then to make recommendations to TxDOT <br />regarding the future operation of said crossover. <br /> <br />WHEREAS, the City Manager of the City of Paris and his staff have studied the issues <br />related to the proposed grade separation project on US 82/ US 271 at Pine Mill Road, and the <br />
