<br />RESOLUTION NO. 97 -039
<br />
<br />WHEREAS, the City Council of the City of Paris did heretofore, on the 1st day of
<br />August, 1979, in Resolution No. 1924, approve the execution of a Lease Agreement with F.
<br />Andrew Fasken, Harley Wagnon and Loma Alto Corporation for hangar space at Cox Field
<br />Airport, Paris, Texas; and,
<br />
<br />WHEREAS, the leased premises has been partitioned and partially assigned, resulting in
<br />Billy Winters and wife, Donna Winters, being assigned the north hangar space accessible from
<br />the east and the office space adjacent thereto, being in the northwest corner of the hangar building;
<br />Russell Gifford being assigned the center hangar space accessible from the west; and Loma Alto
<br />Corporation being assigned the south hangar space accessible from the east and the adjacent
<br />storage area lying in the southwest corner of the hangar building; and,
<br />
<br />WHEREAS, during the term of the lease, the hangar has fallen into disrepair due to the
<br />elements, and the lessees expressed a desire the extend the term of the lease and make all
<br />necessary repairs and renovations to the leased premise at their own expenses; and,
<br />
<br />WHEREAS, the City Council of the City of Paris did heretofore, on the 7th day of
<br />November, 1996, in Resolution No. 96-122, authorize the execution of the First Amended Lease
<br />Agreement with Russell Gifford, Loma Alto Corporation, and Billy Winters and wife, Donna
<br />Winters; and,
<br />
<br />WHEREAS, Billy Winters and wife, Donna Winters, Pave expressed their desire to assign
<br />their interest in the lease to Russell Gifford, and Russell Gifford has expressed his desire to accept
<br />such assignment; and,
<br />
<br />WHEREAS, it is deemed appropriate that the form of the Assignment of Lease from Billy
<br />Winters and wife, Donna Winters, attached hereto as Exhibit A, be, in all things approved, and
<br />that the City Manager, Michael E. Malone, be authorized to acknowledge approval of said
<br />assignment by signing the same; NOW, THEREFORE,
<br />
<br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the
<br />form of the Assignment of Lease from Billy Winters and wife, Donna Winters, to Russell Gifford,
<br />attached hereto as Exhibit A, for hangar space at Cox Field Airport. be, and the same is hereby,
<br />approved; and,
<br />
<br />BE IT FURTHER RESOLVED, that the City Manager of the City of Paris, Michael E.
<br />Malone, be, and he is hereby, authorized and directed to acknowledge approval, on behalf of the
<br />City of Paris, of the Assignment of Lease from Billy Winters and wife, Donna Winters, to Russell
<br />Gifford by signing the same.
