<br />CERTIFIED ASSURANCES <br /> <br />The applicant hereby assures and certifies that the project ....ill comply ....ith the regulation, policies, guidelines and <br />requirements including OMB Circulars No. .11.-122, .11..110, .11.-102, and .11.-87, as they relate to the application, accep- <br />tance and use of funds for this projecL Also the applicant assures and certifies to the grant that: <br /> <br />1. It possesses legal authority to apply for the grant; that a resolution, motion or similar action has been duly adopted or <br />passed as an official act of the applicant's governing body, authorizing the filing of the application including all under- <br />standings and assurances contained therein, and dmaing and authorizing the person identified as the official representative <br />of the applicant 10 act in connection with the application and 10 provide such additional information as may be required. <br /> <br />2. Fedenll funds made available under this formula grant will not be used to supplant state or local funds, but will be used to <br />increase the amounts of such funds that would, in the absence of federal funds, be made a\'ailable for law enforcement <br />activities. <br /> <br />3. <br /> <br />Matching funds required to pay the non-fedenll portion of the cost of each program and project, for ,,!lith grant funds are <br />made a\'ailable, shall be in addition to funds that would otherwise be made available for Jaw enforcement by the recipients <br />of grant funds, <br /> <br />It will comply with requirements of the provisions of the Uniform Relocation Assistance and Real Propeny Acquisitions <br />Act of 1970 (P, 1. 91.646) ,,!lich pro\~des for fair and equitable treannent of persons displaced as a result offederal and <br />federally assisted programs. <br /> <br />It will comply ",ith the minimum wage and max.imUlD hours pro\isions of the federal Fair Labor Standards Act, as they <br />apply 10 hospital and educational instiwtion employees of State and local go\'ernments, <br /> <br />It will establish safeguards 10 prohibit employees from using their positions for a pwpose that is or gives the appearance of <br />being moti\'ated by a desire for private gain for themselves or others, particularly those "1th whom they have family. <br />business, or other ties. <br /> <br />Fund accounting, auditing, monitoring, and such e\'aluation procedures as IDa)' be necessaxy to keep such records as CJD <br />or the Comptroller General shall prescribe, shall be prO\ided to assure fiscal control, proper management, and efficient <br />dis bursemem of funds received under the grant <br /> <br />It shall maintain such data and infonnarion and submit such reports, in such form, at such times, and containing such <br />infonnarion as CJD may require. <br /> <br />The progra11lS contained in its application meet all requirements, that all the information is correct, that there has been <br />appropriate coordination "ith affected agencies, and that the applicant will comply \,ith all prO\isions of the grant and all <br />other applicable federal and state laws, regulations, and guidelines. <br /> <br />It will comply with all requirements imposed by the Federal sponsoring agency concerning special requirements ofla"" <br />program requirements, and other administrative requirements. <br /> <br />Pursuant to Sections 223(a)(18) and 296 of the JJDP Act, the Grantee assures that procedures have been established to <br />ensure that programs funded under the JJDP Act shall not disclose program records containing the identity of indi\idual <br />juveniles. Exceptions to this requirement (a) authorization by la"~ (b) consent of either the juvenile or his legally autho- <br />rized representative; or (c) justification that otherwise the functions of this title cannot be perl'ormed. Under no circum- <br />stances may public project reports or findings contain names of acwal juvenile seT\ice recipients. <br /> <br />It ",ill insure that the facilities under its ownership, lease or supeI'\ision which shall be utilizedm the accomplishment of the <br />project are not listed on the Em1ronmental Protections Agency's (EP A) list ofVioJating Facilities and that it "ill notify the <br />F edenll grantor agency of the receipt of any co=unication from the Director of the EP A Office of Federal Acti\ities . <br />indicating that a facility to be used m the project is under consideration for listing by the EP A. <br /> <br />It "ill comply "ith the flood insurance purchase requirements of ~ 102 (a) of the Flood Disaster Protection Act of 1973, <br />Public Law 93.234,87 Stat 975, approved O=mber 31,1976.
