Commission Questions: <br />Q — When did this catch fire? <br />A — Not sure. Been at least 6 months. <br />Motion was made by Mike Folmar, seconded by Ben Vaughan to accept <br />Robert's recommendation. Motion carried unanimously. 6-0 <br />G. First National Bank — NW Corner; City Block 8, Lot 7 & 8 <br />Owner: CTRA Property Holdings Corp., 8004 Two Coves Dr., Austin TX <br />78730 <br />Robert Talley stated no contact with owner. Received complaint from <br />neighboring business that pieces from roof were falling off. Confirmed this was <br />the case. Piece of safety fence was missing; has been replaced. Parts of <br />parapet underneath missing. <br />Robert Talley's recommendation: Declare a nuisance, repair of parapet <br />within 30 days, or back to BSC at which time we can entertain civil penalties. <br />Commission Questions: <br />Q — Do we have to wait the 30 days? <br />A — Yes; State Law gives owner 30 days to appeal. <br />Q — Is distance from wall and fencing adequate? <br />A — Yes; but that's just my opinion. <br />Q — Can netting be added to chain link fence to prevent small pieces from <br />flying through? <br />A — We're already absorbing a cost for the fencing; don't know how much <br />more the netting would cost. <br />Q — If a piece falls off and causes damage or harm, are we responsible? <br />A — No. <br />Q — Does the city have a responsibility to prevent debris from harming <br />someone or causing damage? <br />A — The city is not under obligation or liable for harm or damages. The <br />fence was put up to keep people off sidewalk because of it's condition. <br />Q — Can we require the owner to put up netting or repair the sidewalk to <br />make it safer? <br />A — Yes to both. <br />Motion was made by Sally McEwin, seconded by Ben Vaughan to accept <br />Robert's recommendation. Motion carried unanimously. 6-0 <br />4. Code Enforcement update. <br />Demo contractors are caught up with Resource Mgmt, and back on our work load. <br />House on Pine Bluff has been demoed; 13th & Graham up next; 41s' SE coming up. <br />These were moved up due to complaints. 600 blk 12th SE and house on 12th NE, both <br />on list. <br />
