rezoning is rarely in the public interest and, if legally challenged, can be held to be invalid. <br />Instead, decisions should be based on whether the land is appropriate for the proposed zoning <br />district and in light of the Paris Comprehensive Plan recommendation. The recommended <br />factors that should be considered for each rezoning application include: <br />1. The character of the neighborhood; <br />2. The zoning and uses of properties nearby; <br />3. The suitability of the subject property for the uses to which it has been restricted; <br />4. The extent to which removal of the restrictions (or change of zone) will detrimentally <br />affect nearby property; <br />5. The length of time the property has remained vacant as zoned; <br />6. The relative gain to the public health, safety and welfare by not rezoning the property as <br />compared to the hardship imposed on the property owner; <br />7. The adequacy of public utilities and other needed public services; <br />8. The recommendation of city staff; and <br />9. Compliance with the Paris Comprehensive Plan. <br />When considering a rezoning application all of the uses which the proposed zoning district <br />permits should be considered rather than just the use the applicant proposes, since a change in <br />ownership or in market conditions could easily result in a change of the proposed use to any of <br />the other permitted uses in said zoning district. <br />(B) Special Use Permits (Same as Specific Use Permits in Paris). The granting of a special use <br />permit or a specific use permit requires a case-by-case approach. The Paris Zoning Ordinance <br />states conditions that must be met before a specific use permit may be granted. The zoning <br />district regulations where the subject property is located may establish additional conditions. <br />The recommendation to grant a specific use permit should be made to the City Council only <br />after the Planning and Zoning Commission has found all the standards as set forth in the zoning <br />regulations have been met. Appropriate factors for consideration of a specific use permit <br />application include: <br />1. The location and size of the proposed use in relation to the site and to adjacent sites <br />and uses of property; and the nature and intensity of operations proposed thereon. <br />2. Accessibility of the property to police, fire, EMS, refuse collection and other municipal <br />services; adequacy of ingress and egress to and within the site; traffic flow and control, <br />and the adequacy of off-street parking and loading areas. <br />28 <br />
