Item No. 19 <br />070 M#PWA <br />TO: City Council <br />John Godwin, City Manager <br />FROM: Bob Hundley, Chief of Police <br />SUBJECT: AMMENDING TRAFFIC CODE SECTION 31-51 <br />DATE: October 29, 2018 <br />BACKGROUND: The Traffic Code Ordinance 31-51(c) details probable cause for an officer to <br />stop any truck on a public street other than a designated truck route for a reasonable amount of <br />time to verify compliance with the truck route ordinance, Article II, Operations of Vehicles, <br />Division 3 Truck Routes. <br />STATUS OF ISSUE: The ordinance, as written, has resulted in some difficulties in enforcement <br />and prosecution, and that the proposed amendment, which changes the exception for deliveries <br />and pickups off the designated through truck routes to a defense to prosecution, will make <br />enforcement and prosecution much easier. <br />BUDGET: There is no impact to the budget. <br />RECOMMENDATION: A motion to amend the ordinance as presented to the council is <br />recommended. <br />
