Regular Council Meeting <br />December 10, 2018 <br />Page 3 <br />CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY <br />CLAUSE; AND PROVIDING AN EFFECTIVE DATE. <br />City Manager John Godwin explained that George Fisher previously applied for a zoning <br />change from Agricultural to Commercial and the Planning and Zoning Commission denied that <br />request on November 5. He said Mr. Fisher withdrew his request so it was not presented to City <br />Council, and he had since re-applied to change the zoning to general retail. Mr. Godwin said <br />general retail was consistent with the recently amended future Land Use Plan and that the <br />Planning and Zoning Commission unanimously approved the request. <br />Mayor Clifford opened the public hearing and asked for anyone wishing to speak in favor <br />or opposition of this item, to please come forward. Brian Palmer, 3765 Leigh Drive; Debbie <br />Padgett, 3735 Leigh Drive; and Ruth Patterson, 320 29th Street, all spoke in opposition of the <br />zoning change because they did not know what was going to be constructed on the property. <br />Christie Wendell, 4142 Primrose, said she was not opposed to the zoning change but was <br />concerned what the next step would be because they did not know what was goring to be built on <br />the property. With no one else speaking, Mayor Clifford closed the public hearing: <br />Mr. Godwin said 'this item was about rezoning of the property, and that at this `time, staff <br />did not know what was going to be. on the property. lie said a site plan would be required before <br />anything was built and that is when staff would know what was being proposed for the property. <br />Mr. Godwin said' it could not be placed on hold but that a vote would need to be taken on the <br />rezoning application. ' <br />Council 'Member Portugal said the property was in her district and because of the <br />concerns of her constituents, she could not support this. Council Member Pilgrim said Mr. <br />Fisher and Mr. Ressler were attempting to develop land, Ahe City had a comp plan and he felt <br />they should follow the comp plan. He said general retail was not going to lower the property <br />values and that he completely supported Mr. Fisher. Council Member Stone said not knowing <br />what was going to go on the property was a concern for her. Mayor Clifford said Planning and <br />Zoning approved the zoning change, that it followed the City's master plan and it was consistent <br />with the long term plan, so he was in support of the zoning change. Council Member Knox said <br />she looked at several developments of Mr. Fisher and he was a good developer. She said she <br />agreed with Council Member Pilgrim and Mayor Clifford. Council Members Trenado and <br />Hughes also voiced support of the zoning change. Mr. Fisher answered questions from City <br />Council. <br />A Motion to approve the zoning change was made by Mayor Clifford and seconded by <br />Council Member Hughes. Motion carried, 5 ayes ® 2 nays, with Council Members Portugal and <br />Stone casting the dissenting votes. <br />14.
