RESOLUTION NO. 94-139 WHEREAS, the City Council of the City of Paris did heretofore in Resolution No. 94-123, authorize the procurement of right-of-way for the construction of a new street from the West boundary line of 1st Street S.W., formerly Wall Street, to a point in the center line of 4th Street S.W. along the old Southern Pacific Railroad Right-of- Wll-Y; and, WHEREAS, the City Council of the City of Paris did heretofore in Resolution No. 94-129, authorize the City Attorney to make a final offer of the appraised amount of the referenced right-of-way; and, WHEREAS, the City Attorney reached agreement with Southern Pacific Transportation Company on a consideration of $8,500.00 for the property described on Exhibit A attached hereto, being the appraised price plus the estimated cost of condemnation, and said agreement must be ratified by the City Council of the City of Paris and such ratification must be returned to Southern Pacific Transportation Company prior to November 11, 1994; and, WHEREAS, there being no regular scheduled council meetings which would accommodate such ratification, it is found to have been necessary to call an emergency special council meeting for 4:30 p.m. on this the 3rd day of November, 1994, in order to meet the time restraint enumerated; NOW, THEREI<'ORE, BE IT RESOLVED BY THE CITY COUNCIL 01<' THE CITY OF PARIS, that the agreement of the City Attorney with Southern Pacific Transportation Company for a consideration of $8,500, for the property described on Exhibit A attached hereto, be, and the same is hereby ratified and accepted; and, BE IT FURTHER RESOLVED, that the City Clerk of the City of Paris, Mattie Cunningham be, and she is hereby directed to prepare a certified copy of this resolution to be transmitted to Southern Pacific Transportation Company.
