Section1.ThatthefindingssetforthinthisOrdinanceareherebyinallthingsapproved. <br />Section2.That,withoutprejudicetofuturelitigationofanyissueidentifiedbyACSC, <br />theCityCouncilfindsthatthesettledamountofanincreaseinrevenuesof$35.4million for <br />ACSCCitiesrepresentsacomprehensivesettlementofgasutilityrateissuesaffectingtherates, <br />operations,andservices offeredbyAtmosMid-Texwithinthemunicipallimitsarising from <br />AtmosMid-Tex's2019RRMfiling,isinthepublicinterest,andisconsistent withtheCity's <br />authorityunderSection103.001oftheTexasUtilitiesCode. <br />Section3.ThattheexistingratesfornaturalgasserviceprovidedbyAtmosMid-Texare <br />unreasonable.ThenewtariffsattachedheretoandincorporatedhereinasExhibitA,arejustand <br />reasonable, andaredesignedtoallowAtmosMid-Textorecoverannuallyanadditional$35.4 <br />millionfromcustomersinACSCCities, overtheamount allowed under currently approved <br />rates. Suchtariffsareherebyadopted. <br />Section4.Thattheratemakingtreatmentforpensionsandretireemedicalbenefitsin <br />AtmosMid-Tex'snextRRMfilingshallbeassetforthonExhibitB,attachedheretoand <br />incorporatedherein. <br />Section5.Thatamortizationofregulatoryliabilityshallbeconsistentwiththeschedule <br />foundinattachedExhibitCattachedheretoandincorporatedherein. <br />Section6.ThatAtmosMid-Texshallreimbursethereasonableratemakingexpensesof <br />theACSCinprocessingtheCompany's2019RRMfiling. <br />Section7.Thattotheextentanyresolutionorordinancepreviouslyadoptedbythe <br />CouncilisinconsistentwiththisOrdinance,itisherebyrepealed. <br />3 <br /> <br />
