<br />CEiTlflCATIOI iECAiDIIC DRUG-fiEE WORI PLACE REQUliEKEITS <br /> <br />CERTIFICATION <br /> <br />I, The grantee certifies that it will provide a drug-free work place hy: <br /> <br />(a) puhlishing a statelent notifying elployees that the unlawful lanufacture, <br />distrihution, dispensing, possession, or use of a controlled suhstance is prohihited <br />in the grantee's work place and specifying the actions that will he taken against <br />elployees for violation of such prohibition; <br /> <br />Ih) establishing a drug-free awareness progral to inforl elployees ahout: <br /> <br />(I) the dangers of drug ahuse in the work place; <br />(2) the grantee's policy of ..intaining a drug-free work place; <br />(3) any availahle drug counseling, rehahilitation, and elployee assistance <br />progralS; and <br />(4) the penalties that lay he ilposed upon elployees for drug ahuse violations. <br /> <br />Ie) laking it a requirelent that each elployee he engaged in the perforaance of the grant <br />he given a copy of the statelent required by paragraph (a): <br /> <br />(d) notifying the elployee in the statelent required hy paragraph la) that, as a condition <br />of elploYlent under the grant, the elployee will: <br /> <br />(I) abide by tbe terls of the statelent; and <br /> <br />(2) notify the eaployer of any cri.inal drug statute conviction for a violation <br />occurring in the work place not later than five days after such conviction. <br /> <br />(e) notifying the agency within ten days after receiving notice under suhparagraph Id)12) <br />fro. an elployee or otherwise receiving actual notice of such convictionj <br /> <br />If) taking one of the following actions with respect to any e.ployee who is so convicted: <br /> <br />II) taking appropriate personnel action against such an elployee, up to and <br />including terlinationj or <br /> <br />(2) requiring such eaployee to participate satisfactorily in a drug ahuse <br />assistance or rehabilitation program approved for such purposes hy a federal, <br />state, or local health, law enforcelent, or other appropriate agency; <br /> <br />Ig) laking a good faith effort to continue to .aintain a drug-free work place through <br />ilpleaentation of paragraphs lal, (hl, (e), ld), (e), and (f). <br />
