John Ankrum, the building official, informed the board of the need of the variance, <br />which was brought to our attention during a remodel, is required for the title <br />company to complete any future sale of the property. He also addresses that though <br />it encroaches on a utility easement he does not believe there will be any issues since <br />the utilities are already in place elsewhere. Ankrum acknowledges that the house is <br />existing and recommends approval. <br />Jeff White, of 2925 Margaret St, follows up Ankrum's statement and informs the <br />board that future title companies will not sign off on the home if it is not in <br />compliance. <br />No one else spoke in favor or opposition, <br />Public hearing was declared closed. <br />Motion was made by Benny Plata, seconded by Brady Fisher to approve the variance <br />to Section 9-600 of the Zoning Ordinance. Motion carried 5:0. <br />4. Public hearing to consider and take action on the petition of Kolton Porter on <br />Lots 34 through 39, City Block 1, Lamar Terrace subdivision, being located at <br />2213 Hubbard St. <br />The petition requested a variance of Section 11.5-3 (b)(1)(a) of the Zoning <br />Ordinance which provides as follows: <br />(1) Front yard fence requirements. <br />a. No fence shall be permitted in the front yard with the following exceptions: <br />i. On lots zoned in historic overlay district (HD) and in accordance with the <br />design standards adopted by the historic preservation commission. <br />ii. On lots in excess of two (2) acres in size which are used for single-family <br />residential purposes. <br />iii. On lots which are zoned and used for LI or HI purposes. <br />The applicant is requesting a variance to reconstruct an existing legal, non- <br />conforming front yard fence that does not meet the ordinances' requirements. <br />Public hearing was declared open. <br />
