<br />RESOLUTION NO. <br /> <br />92-074 <br /> <br />WHEREAS, the L. P. McCuistion Sanitarium Foundation did <br />by deed dated October 3, 1988, convey to the County of Lamar <br />Lots I and 2, Block 8, Smith First Addition to the City of <br />Paris; and, <br /> <br />WHEREAS, said lots had delinquent taxes in favor of the <br />City of Paris and Lamar County; and, <br /> <br />WHEREAS, the City of Paris has approved a project of <br />construction wherein Martin Luther King, Jr. Drive is to be <br />extended from 6th Street N.E., west to North Main Street, the <br />planned right of way of which will eliminate Lot 3, City <br />Block 74A as an acceptable building lot, which lot is <br />currently owned by Edgar Chester and wife, Floy Chester; and, <br /> <br />WHEREAS, the Chester's are agreeable to accepting Lots <br />1-2, Block 8, Smith 1st Addition in trade for said Lot 3, <br />City Block 74A; and, <br /> <br />WHEREAS, said Lots 1 and 2, Block 8 Smith 1st Addition <br />will be used as a building lot upon which Edgar Chester and <br />Floy Chester desire to move their existing home which will <br />upgrade the neighborhood and place said lot in an active <br />status on the tax rolls of the several joint owner tax <br />entities; and, <br /> <br />WHEREAS, it is deemed to be in the best interest of the <br />citizens of Paris to ask for the cooperation of the County <br />of Lamar to convey said property to the City of Paris in <br />order that we may convey it in trade to the Chesters; NOW <br />THEREFORE, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, <br />that the City Attorney, T. K. Haynes, be and he is hereby <br />authorized to procure Lots I and 2, Block 8 of the Smith 1st <br />Addition from the County of Lamar through a Special Warranty <br />Deed in the form of Exhibit A attached hereto; and, <br /> <br />BE IT FURTHER RESOLVED, that upon the receipt of Lots 1 <br />and 2, Block 8 of the Smith 1st Addition, the mayor of the <br />City of Paris, George Fisher, be and he is hereby authorized <br />to execute on behalf of the City of Paris, a General Warranty <br />Deed in the form of Exhibit B attached hereto, conveying said <br />property to Edgar Chester and wife, Floy Chester in trade for <br />the conveyance of Lot 3, City Block 74A to the City of Paris. <br /> <br />Passed and adopted this the 14th day of September, 1992. <br /> <br />CITY OF PARIS, PARIS, TEXAS <br /> <br /> <br />~hl-~ <br /> <br />ATTEST: <br />
