<br />STATE OF TEXAS <br />COUNTY OF LAMAR <br /> <br />~ <br />~ <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />THAT, the CITY OF PARIS, Paris, Texas, a municipal <br />corporation, acting by and through its Mayor, George Fisher, <br />duly authorized, hereinafter called CITY and DOBBS TENNIS <br />COURTS, INC., acting by and through its President, Danny <br />Dobbs, hereinafter called DOBBS do hereby contract and agree <br />as follows: <br />1. DOBBS agrees to resurface tennis courts 1, 2 and 3 <br />at Culbertson Park in accordance with the specifications and <br />bid documents attached hereto as Exhibit A. <br />2. DOBBS agrees to resurface tennis courts 1, 2 and 3 <br />at Culbertson Park for a total price of $12,750.00. Upon <br />completion of the removal of spaulded concrete, CITY will pay <br />DOBBS $4,500.00, with the remainder to be paid upon <br />completion and acceptance of the job. <br />3. It is agreed and understood by both parties that <br />said resurfacing cannot be completed until the temperature is <br />50 degrees or above with good drying conditions. <br />4. City has the right to unilaterally terminate this <br />agreement at any time due to poor quality of work or non- <br />performance. <br /> <br />EXHIBIT A <br />
