Item No. 19 <br />memorandum <br />TO: Mayor & City Council <br />Gene Anderson, Interim City Manager <br />FROM: Carla Easton, PE, Engineering & Community Development Director <br />SUBJECT: OFFUTT ADDITION #3 FINAL PLAT <br />DATE: March 11, 2020 <br />BACKGROUND: Marx Offutt owns four parcels at the southeast corner of N Main at Santa Fe <br />Street, currently used as a car lot. He is proposing to plat the properties as a single lot in order to <br />add a building for detailing cars. The current zoning is Commercial (C). <br />STATUS OF ISSUE: The owner has submitted preliminary and final plats of the property. <br />Water and sewer service is available along N Main and 1St St SE. The plat reflects an existing <br />condition worthy of noting. One of the existing portable buildings on the lot is located within an <br />existing 15' utility easement, and potentially on top of a city sewer main. The proposed building <br />will not affect the easement, however the owner has been notified that should any maintenance <br />be required on the city sewer main in this area he will be responsible for moving the building, at <br />his cost. It appears that the plat complies with the City of Paris subdivision regulations. <br />Staff's recommendation was to approve the final plat with note regarding the existing structure. <br />The final plat was approved by the Planning & Zoning Commission on March 2"d. Due to <br />unforeseen circumstances, this plat was approved by operation of law because it was not <br />approved or denied by the municipal authority within thirty days after the plat was filed (Texas <br />Local Government Code Sections 212.009 & 212.0091). <br />RECOMMENDATION: Acknowledge approval of the final plat with note regarding existing <br />structure. <br />
