Item No. 28 <br />Memorandum <br />TO: Mayor & City Council <br />Grayson Path, City Manager <br />FROM: Doug Harris, Director of Utilities <br />SUBJECT: REVISION TO ORDINANCE 2004-015, ARTICLE III, CHAPTER 34 OF <br />THE CODE OF ORDINANCES — WASTEWATER DISCHARGE AND <br />DISPOSAL <br />DATE: July 27, 2020 <br />BACKGROUND: <br />The City of Paris administers an Industrial Pretreatment Program, as required by the U. S. <br />Environmental Protection Agency and Texas Commission on Environmental Quality, under the <br />Clean Water Act, Texas Water Code and 40 CFR Part 403. The authority for this program is found <br />in the City of Paris Code of Ordinances, Wastewater Discharge and Disposal, Article III, Chapter <br />34, Ordinance 2004-015. <br />STATUS OF ISSUE: <br />The EPA adopted changes to the National Pretreatment Program under 40 CFR 403, specifically <br />requiring Industrial Pretreatment Programs to implement the Pretreatment Streamlining Rule. This <br />rule requires industrial dischargers to use treatment techniques and management practices to <br />reduce or eliminate the discharge of harmful pollutants to sanitary sewers. TCEQ, as the regulatory <br />authority in Texas, requires municipalities to implement this rule change into existing Industrial <br />Pretreatment Programs. The City of Paris Code of Ordinances, Wastewater Discharge and <br />Disposal, Article II, Chapter 34, Ordinance 2004-015 was revised to include the required rule <br />changes. TCEQ has reviewed the revised ordinance and notified the City of Paris the amendments <br />are acceptable, and, upon adoption, will signify the City of Paris Industrial Pretreatment Program <br />is in compliance with standardized rules, regulations and policies. <br />BUDGET: <br />There is no budget impact. <br />
