The notice of the hearing shall be served personally or by registered or certified mail at <br />least ten (10) days before the hearing. Service may be made on any person, or any agent <br />or officer of a corporation. <br />(6) Fees. <br />a. Permits. Each person shall include with an application for permit an initial fee of one <br />hundred dollars ($100.00), with an annual renewal fee of fifty dollars ($50.00). <br />b. Waste disposal at POTW. Waste transporters utilizing the city POTW will be charged <br />a minimum fee of thirty-three dollars ($33.00) for one thousand (1,000) gallons, and <br />all over one thousand (1,000) gallons shall be pro -rated at the minimum fee for one <br />thousand (1,000) gallons. Waste transporters may also be surcharged for wastes that <br />exceed the parameters of normal domestic wastewater as established in section 34- <br />86(a). This charge will be based upon the strength of a representative grab sample <br />from each load. Fees shall be reviewed ori a regular basis by the city council and <br />adjusted as necessary to reflect true costs to the city. No wastes shall be accepted <br />containing prohibited sub stances as described in section 34-105 <br />Secs. 34-132-34-149. - Reserved. <br />Section 3. That all provisions of the ordinances of the City of Paris, Texas in conflict <br />with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances <br />of the City of Paris not in conflict with the provisions of this ordinance shall remain in full force <br />and effect <br />Section 4. That the repeal of any ordinance or part of ordinances affected by the <br />enactment of this ordinance shall not be construed as abandoning any action now pending under <br />or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any penalty <br />accruing or to accrue, or as affecting any rights of the municipality under any section or provisions <br />of any ordinance at the time of passage of this ordinance. <br />Section 5. That it is the intention of the City Council of the City of Paris, Texas that <br />this ordinance, and every provision hereof, shall be considered severable, and the invalidity or <br />partial invalidity of any section, clause, or provisions of this ordinance shall not affect the validity <br />of any other portion of this ordinance. <br />Section 6. That Section 2 of this ordinance notwithstanding, the repeal of prior Article <br />III of Chapter 34, Sections 34-51 through 34-131 of the Code of Ordinances of the City of Paris, <br />Paris, Texas shall not affect any pending or subsequent prosecution, other enforcement action, <br />other litigation for violations of the provisions of Chapter 34 repealed herein, when such violations <br />occurred prior to the effective date of this ordinance, it being the intention of the City Council that <br />aforesaid repealed provisions be continued in full force and effect to the extent necessary and as <br />Page 44 of 45 <br />
