Item No. 21 <br />KER�M-�M <br />TO: Mayor & City Council <br />FROM: Grayson Path, City Manager <br />SUBJECT: CONFIRMATION OF INTERIM CHIEF OF POLICE <br />CONFIRMATION OF INTERIM FIRE CHIEF <br />DATE: August 24, 2020 <br />16.1 <br />X161 X0 <br />In consultation with our retained Civil Service Legal Counsel, the Interim Chief of Police and <br />Interim Fire Chief need to be appointed by the chief executive and confirmed by the Governing <br />Body in order to serve in these Department Head roles. This is pursuant to Texas Local <br />Government Code 143.013(a)(1) which says "(a) Unless elected, each department head is: (1) <br />appointed by the municipality's chief executive and confirmed by the municipality's governing <br />body;". Chapter 143 is in essence the Civil Service Commission Code that governs the City of <br />Paris Fire Department and Police Department. This is a housekeeping and cleanup agenda request. <br />While Interim Fire Chief Thomas McMonigle and Interim Chief of Police Randy Tuttle were <br />announced to serve in these roles, the City Council was not asked to confirm them via vote. <br />Thomas McMonigle has served in the role as Interim Fire Chief since October 2019 and Randy <br />Tuttle has served in the role as Interim Chief of Police since July 2020. <br />STATUS OF ISSUE: <br />In order to be in compliance with Local Government Code and Civil Service Code, the City <br />Manager is requesting that the City Council vote to confirm Thomas McMonigle as the Interim <br />Fire Chief and Randy Tuttle as the Interim Chief of Police. This will allow them to fulfill these <br />duties in compliance with law. <br />The City Manager is currently advertising for the Fire Chief position and will follow this process <br />by advertising for the Chief of Police position. <br />
