Item No. 12 <br />TO: Mayor & City Council <br />FROM: Grayson Path, City Manager <br />SUBJECT: NASH Wall <br />DATE: November 9, 2020 <br />�G X-11610L"I <br />On July 27, 2020, the City Council approved an agreement with Gary and Rebecca Nash to partner <br />together in funding the installation of new gabion-style retaining walls in the drainage way behind <br />their property. The City had performed a sanitary sewer and erosion protection project in this area, <br />but at the time it was agreed that the Nash's sackrete wall would remain in place. The sackrete <br />wall subsequently failed. The Nash's and City came to an agreement to partner together to fund <br />the replacement of this wall. Bids were received and opened on October 1, 2020. <br />STATUS OF ISSUE: <br />A total of five (5) bids were received ranging from $56,985.00 to $88,500.00. The lowest bid <br />came from Bernal Commercial Construction for $56,985.00. Hayter Engineering has <br />recommended that the City Council award the bid to Bernal Commercial Construction and for City <br />Staff and Hayter Engineering to begin constructing the contractual documents. <br />BUDGET: <br />Per an agreement with Gary and Rebecca Nash, as well as a proposed amendment on your <br />agenda tonight, the City has agreed to spend no more than $25,000.00 on this project, to be <br />amended to $33,000.00 if the City Council approves of the amendment. Expenses would be for <br />both Bernal Commercial Construction as well as Hayter Engineering. The remaining amount <br />will be covered by Gary and Rebecca Nash. The total estimated cost for the project is <br />$68,260.00. <br />Side note, at the time of negotiation with Hayter Engineering for their services, the City had an <br />on -staff City Engineer who was going to perform some services not listed in the Hayter <br />Engineering contract in order to save expense. With Hayter Engineering identified to serve as the <br />Interim City Engineer (also on your agenda tonight), they will in fact serve in their contractual role <br />
