Grentee Procurement Pecords. <br /> <br />Grantees shall maintain records sufficient to detail the si~r.ificant his- <br />tery of a prccure!Cent. These records shall include, but are not necessarily <br />lir;1ited to, info~ation pertinent to the following: raticnale for the methcd <br />of procure::-ent, selectien of contract type, contractor selection or rejec- <br />ticn, and the basis for the cost or price. <br /> <br />14. Centract Provisions. <br /> <br />In addition to proviSions defining a sound and complete procurement con- <br />tract, any recipient of Federal grant funds shall include the following con- <br />tract provisions or conditions in all procurement contracts and subcontracts <br />as re~~ired by the provision, Fed~ral law or the Grantor Agency. <br /> <br />A. Contracts other than small purchases shall contain provisions or con- <br />ditions I"hich l'Iill allcl'l for administrative, contractual, or legal <br />re::-edi es in instances l'Ihere contractcrs vi 01 ate or breach contract <br />te~s, and provide for such sanctions and penalties as may be appro- <br />priate. <br /> <br />8. All contracts in excess of S10,000 shall contain suitable proviSions <br />for termination by the Grantee including the manner by which it will <br />be effected and the basis fer settlement. In addtiion, such con- <br />tracts shall describe conditions under l'Ihich the contract may be ter- <br />minated for default as well as conditions where the centract may be <br />temi nated because of ci rcumstances beyond the control of the con- <br />tractor. <br /> <br />C. All contracts awarded in excess of SlO,OOO by Grantees and their <br />contractors or subgrantees shall contain a provision requiring com- <br />pliance with Executive Order 11246, entitled "Equal Employment Oppor- <br />tunity", as amended by Executive Order 11375, and as supplemented in <br />Department of Labor regulations (41 CFR Part 60). <br /> <br />D. All contracts and subgrants far construction or repair shall include <br />a pro'/ision for compliance with tr.e Cepeland "Anti-Kic~back" Act (13 <br />use 874) as supplemented in Department of Labor regulations (29 CFR, <br />Part 3). This Act prevides that each contractor or subgrJntee shall <br />be prohibited frem inducing, by any means, any person employed in the <br />construction, cCT.loletlon, or repair of pUblic l'/ork, to give up any <br />part of the cCT.lpensation to which he is othenlise entl tled.
