<br />LEASE AGREEMENT <br /> <br />CITY OF PARIS & <br />STATE DEPARTMENT OF HIGHWAYS & PUBLIC TRANSPORTATION <br /> <br />STATE OF TEXAS S <br />~ <br />COUNTY OF LAMAR S <br /> <br />THIS INDENTURE by and between the CITY OF PARIS, LAMAR <br />COUNTY, TEXAS, hereinafter called LESSOR, and the STATE DEPART- <br />MENT OF HIGHWAYS AND PUBLIC TRANSPORTATION, hereinafter called <br />LESSEE, witnesseth: <br /> <br />FOR, and in consideration of One ($1.00) Dollar in hand paid <br />and the agreement to maintain the fixtures, driveways and other <br />improvements placed thereon and to otherwise maintain the neat, <br />attractive appearance of the same throughout the full term <br />whereof, and other valuable considerations; LESSOR, in pursuance <br />of authority vested in it by Resolution of its City Council for <br />Park purposes, failure to so use same to void lease without any <br />action on the part of LESSOR, with reservation by LESSOR of all <br />mineral and oil rights, and all rights necessary to develop oil <br />and minerals therein, has leased and let and does hereby 'lease <br />and let unto LESSEE for a term of Fifty (50) Years beginning May <br />1, 1988, the PROPERTY SHOWN AS TWO TRACTS ON Exhibit A attached <br />hereto and made a part hereof for all legal purposes and which <br />tracts are described as follows, to-wit: <br /> <br />TRACT NO.1 - Being a tract of 0.70 acres of land deeded to <br />said City of Paris by Mrs. Sarah A. Hull as recorded in Vol. 245, <br />Page 310 of the Deed Records of Lamar County, and a part of a <br />survey originally granted to R. Russell, being more particularly <br />described as follows: <br /> <br />.. <br /> <br />Beginning at a point in the East Right-of-Way lines of <br />the St. L., S. F. & T. Railroad and in the center of a <br />county road running East and West on the South side of the <br />Frisco School, North of Paris; thence South 6 deg. 18', West <br />70 feet along the East Right-Of-Way lines of said Railroad; <br />thence South 53 deg. 42' East 209.5 feet; thence Easterly <br />100 feet along a curve having a radius of 50 feet and a <br />central angle of 125 deg. 48'; thence North 0 deg. 30' East <br />134 feet to the center of above mentioned county road; <br />thence West along the center of said road 250 feet to the <br />place of beginning, and containing 0.70 acres of land more <br />or less. <br /> <br />TRACT NO.2 - Being a tract of 2.21 acres of land deeded to <br />said City of Paris by Mrs. Sarah Hull as recorded in Vol. 245, <br />Page 311, of the Deed Records of Lamar County, and a part of a <br />survey originally granted to R. Russell, being more particularly <br />described as follows: <br /> <br />Beginning at a point South 6 deg. 18' West 70 feet from <br />a point in the EAst Right-of-Way line of the St. L., S. F. & <br />T. Railroad and in the center of a County road running East <br />and West on the South side of the Frisco School North of <br />Paris; thence South 6 deg. 18' West 230.8 feet along the <br />East Right-of-Way line of said St. L., S.
