Form 1038 (Rev. 03112) <br />Page 6 of 6 <br />TERMINATION <br />All obligations of the State created herein to maintain and operate the State highways covered by this agreement <br />shall terminate if and when such highways cease to be officially on the State highway system; and further, should <br />either party fail to properly fulfill its obligations as herein outlined, the other party may terminate this agreement upon <br />30 days written notice. Upon termination, all maintenance and operation duties on non -controlled access State <br />highways shall revert to City responsibilities, in accordance with Chapter 311 of the Texas Transportation Code.
