t,0 D <br />DECISION OF THE BOARD OF ADJUSTMENT, CITY OF PARIS, TEXAS <br />RE: Variance Request <br />Russ Davis, on behalf of Johnny and Linda Miles <br />620 Moore St <br />Blossom, TX 75416 <br />ACTION REQUESTED: Variance of l OFT to ROW Requirement at 1415 SE 6" St. <br />The above -reference request was: grante / denied/ granted in part and denied in part) by the <br />City of Paris Zoning Board of Adjustment ("Board") on 05/04/2021 by vote of '-r,7D- in favor <br />and 0 against the application with n abstaining. On this date, the Board found that the <br />request met the conditions set forth in Section VIII (E) 14 & 15 of the City of Paris Subdivision <br />Ordinance. <br />The Board of Adjustment here by approves the variance request without conditions based upon <br />the following findings of fact. <br />Board of Adjustment Findin sof Fact <br />1. There are no unique conditions or features of the property which is not generally common to <br />other properties. <br />2. The literal compliance with Sections VIII (E) 14 & 15 of the Subdivision Ordinance would <br />cause unnecessary hardship given the fact that the roadway to be constructed will not be a <br />collector street, but rather a local residential street with a cul-de-sac. <br />3. The granting of the variance will not violate the spirit or the intent of this article. <br />4. The condition or feature which creates the need for the variance did not result from the property <br />owner's own actions, but rather is a conflicting requirement within the City's Subdivision <br />Ordinance Requirements. <br />5. The variance by the applicant is not solely for personal convenience, financial hardship, or <br />other reasons unrelated to the property. <br />Appeal: Any interested person wishing to appeal this Board decision is required to file a petition <br />for Writ of Certiorari in a district court, county court or county court at law within ten (10) days <br />
