<br />RESOLUTION NO. 87-116 <br /> <br />WHEREAS, the City Manager of the City of Paris has <br />heretofore received a request from David Glass and Barney <br />Bray, III for a pro rata water and sewer extension with lift <br />station and force main to serve their property being devel- <br />oped as Morningside North Addition, adjacent to the South <br />side of Highway 82 East; and, <br /> <br />WHEREAS, it is deemed appropriate to permit David Glass <br />and Barney Bray, III to act as sponsor under the terms of <br />Section IX of the Subdivision Ordinance No. 1315 of the City <br />of Paris with any refunds due under said ordinance being <br />paid to David Glass and Barney Bray, III or their heirs or <br />assigns; and, <br /> <br />WHEREAS, upon receipt of the above described request, <br />preliminary plans, specifications and estimate of the total <br />cost of the project were prepared and delivered to the City <br />Manager and considered at the regular Council Meeting on the <br />14th day of September, 1987, and a public hearing concerning <br />the same was set for October 15, 1987, and continued to <br />November 5, 1987, at which time such public hearing was <br />held; and, <br /> <br />WHEREAS, after hearing the matters presented at the <br />public hearing, the City Council is of the opinion that <br />David Glass and Barney Bray, III are entitled to have a pro <br />rata water and sewer extension and to act as sponsors for <br />said project; and, <br /> <br />WHEREAS, such proj ect should be known as the <br />Morningside North Addition Pro Rata Water and Sewer Line <br />Extension Project which has a total estimated cost of <br />$132,500.00; the front foot method would be inequitable due <br />to the fact that the beneficiaries derive unequal benefits; <br />and the method described on Exhibit A attached hereto, as <br />recommended by the staff, would be equitable; NOW, <br />THEREFORE, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />PARIS, That the pro rata water main extension from the <br />intersection of Carrie Lane with a concrete drive serving <br />Glass Motors from Highway 82 East and a sewer main with lift <br />station constructed on the East end of the property being <br />developed as Morningside North with force main from said <br />lift station West to sewer manhole near the intersection of <br />Carrie Lane and the aforedescribed concrete drive and <br />existing gravity sewer system, be, and the same is hereby <br />approved and shall be known as "Morningside North Addition <br />Pro Rata Water and Sewer Line Extension Project"; and, <br /> <br />BE IT FURTHER RESOLVED, That David Glass and Barney <br />Bray, III act as sponsors of said pro rata water and sewer <br />main extension and pay the total construction cost; and, <br /> <br />BE IT FURTHER RESOLVED, That the front foot rule would <br />not be equitable and the alternate method described in <br />Exhibit A attached hereto of dividing the total cost of said <br />ov~oncinn 'imi~g~ ~n ~hg ~~~im~~prl ~n~~ ~fnrp~~irl_ i~ frn1nrl <br />
