<br />RESOLUTION NO. 87-078 <br /> <br />WHEREAS, the City Council of the City of Paris did <br />heretofore, on April 1, 1985, in Resolution No. 85-025, <br />award the contract for the 1985 Master Pump Station Reha- <br />bilitation Project to Heritage Constructors, Inc.; and, <br /> <br />WHEREAS, during the warranty period following the <br />completion of construction of the Master Pump Station <br />Rehabilitation Proj ect, repeated unexplained automatic <br />disconnection of the variable frequency drive equipment <br />which controls the pump station sewage pumps has occurred; <br />and, <br /> <br />WHEREAS, a continuation of this type of event is not <br />acceptable from a proj ect performance standpoint and addi- <br />tionally is not acceptable due to the potential risk of a <br />sewage bypass which could result from the automatic discon- <br />nection of the pump drives; and, <br /> <br />WHEREAS, the contractor, Heritage Constructors, Inc. <br />has acknowledged the unacceptable performance of the vari- <br />able frequency drive equipment and has discussed the same <br />with the equipment manufacturer, Reliance Electric. The <br />contractor wishes to install isolation transformers on the <br />electrical circuit feeding the pump station in an effort to <br />prove the problem results from the power supply and not from <br />the variable frequency drive equipment; and, <br /> <br />WHEREAS, the city is interested in resolving the <br />problem and does not believe the contractor should be held <br />responsible for the cost of improving the quality of the <br />power supply if it is out of range of normal industry <br />standards and if it is, in fact, causing the service problem <br />with the equipment, the city wishes to modify the con- <br />struction contract to provide terms under which the city <br />will reimburse the contractor for the cost of installing <br />isolation transformers if these transformers solve the <br />problem of unexplained automatic disconnection of the <br />variable frequency drives and which further provides for <br />reimbursement to offset investigative costs provided the <br />result proves the power supply is outside of normal industry <br />standards and is causing the automatic disconnect problem; <br />NOW, THEREFORE, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />PARIS, That the contract for 1985 Master Pump Station <br />Rehabilitation Project is hereby amended by Change Order No. <br />2 attached hereto as Exhibit "A" and the Mayor of the City <br />of Paris, Billy Joe Burnett, is hereby authorized and <br />directed, on behalf of the City of Paris, to execute said <br />Change Order. <br /> <br />Passed and adopted this 23rd day of July, 1987. <br /> <br /> <br />B~b::!o' <br />
