f <br />OU 9 % Ir 6 [tib <br />DECISION OF THE BOARD OF ADJUSTMENT, CITY OF PARIS, TEXAS <br />RE: Variance Request <br />Chance Floyd <br />4135 Jasmine St <br />Paris, TX 75460 <br />ACTION REQUESTED: Variance of 10' to front yard setback on a corner lot <br />The above -reference request was ( an <br />r tedk denied/ granted in part and denied in part) by the <br />City of Paris Zoning Board of Adjustment ("Board") /2021 by a vote of in favor <br />tment Board on 09/07 <br />of the application and against the application with L abstaining. On this date, the <br />Board found that the request met the conditions set forth in Section 9-501 of the Zoning <br />Ordinance Area Regulations. <br />The Board of Adjustment here by approves the variance request based upon the following findings <br />of fact. <br />Board of Ad'ustment Recommended Findings of Fact <br />1. Although there are no unique conditions or features of the property which is not generally <br />common to other properties with similar platted lots in the subdivision, there are other similar <br />situated properties in the development which have constructed privacy fences along 42°d <br />Street in a similar manner and location. <br />2. Approval of the variance will not alter the essential character of the neighborhood along the <br />same street. <br />3. The literal compliance with Sections 9-501 of the Zoning Ordinance would cause unnecessary <br />hardship given the fact that this is an existing lot of record, is a corner lot and is lacking in <br />sufficient area suitable for safe recreation in the rear yard. <br />4. The granting of the variance will not violate the spirit or the intent of this article. <br />5. The condition or feature which creates the need for the variance resulted from the property <br />owner's own actions, but were unintentional and can be mitigated through the variance <br />process, if approved. <br />6. The variance by the applicant is not solely for personal convenience, financial hardship, or <br />other reasons unrelated to the property. The corner lot location substantially impacts the <br />useable space in the yard. <br />
