<br />compatible hardware configurations of the City, under <br /> <br />the terms of this contract, MSCI does not warrant the <br /> <br />feasibility of adapting the application software to <br /> <br />hardware configurations other than the IBM System/36. <br /> <br />2, Ownership of the system's application software will be <br /> <br />retained by MSCI. <br /> <br />The City may utilize the application <br /> <br />software in any way deemed necessary so long as the <br /> <br />application software is limited to the City's computer <br /> <br />system, <br /> <br />Original source code and documentation is provided. <br /> <br />3, The Application Software shall consist of the following <br />Application: <br /> <br />Agenda Indexing <br /> <br />$2,000.00 <br /> <br />--------- <br />--------- <br /> <br />4. For and in consideration of the services to be rendered by MSCI, <br />the City shall pay, and MSCI shall receive, compensation as <br />follows: <br /> <br />A. Application Software License Fee shall be due and payable <br />upon acknowledgement of said CONTRACT. <br /> <br />B, This CONTRACT shall be effective upon execution by the City <br />and MSCI. <br /> <br />C, Installation and training hours will be billed on an as <br />incurred basis at the rate of $50,00 per hour. <br /> <br />D. Travel and Per Diem expenses will be billed on an as incurred <br />basis, and held to a reasonable level not to exceed $100.00. <br />
