requiring a significant amount of research, mailing, and handling of outbound/inbound calls. <br />An hourly fee for such work will likely exceed amount of delinquent taxes due and represent <br />an additional cost to the City. The Tax Code does not expressly authorize the City to pay for <br />collection services based on an hourly fee; and <br />WHEREAS, the City believes this contingent fee contract is in its best interest. GOVT. <br />CODE § 2254.1036(1)(F). Under the contingent fee contract, the Firm will be paid the amount <br />of the percentage -based collection fee, regardless the number of hours the Firm spends to <br />collect the delinquent debt. Additionally, the percentage -based collection penalty is a pass- <br />through expense to the debtor and not an expense to the City or taxpayers in the City. This <br />contract will allow the Taxing Entities to recover delinquent property taxes, penalties and <br />interest that are essential revenue. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />PARIS, TEXAS THAT: <br />Section 1. That the findings set out in the preamble to this resolution are hereby <br />in all things approved. <br />Section 2. The attached Contract for the Collection of Delinquent Taxes, Exhibit A <br />between the CITY and the FIRM is hereby approved, with the initial term of the Contract to <br />begin on October 11, 2021 and remain effective until August 1, 2026. <br />Section 3. The City Manager is hereby authorized to execute the Contract and all <br />other documents in connection therewith on behalf of the City of Paris, substantially <br />according to the terms and conditions set forth in the Contract. <br />Section 3.
