DECISION OF THE BOARD OF ADJUSTMENT, CITY OF PARIS, TEXAS <br />RE: Variance Request <br />Adam Bolton, OBO JAB Heritage Properties <br />405 & 415 NE 25th Street <br />Paris, Texas 75460 <br />ACTION REQUESTED: 2.1' Variance to 25' Build line indicated on Plat for the construction <br />of a duplex. <br />The above -reference request was (grantel / denied / granted in part and denied iLpart) by the City <br />of Zoning f Adj against the lcation with <br />yby a vote of in favor of <br />the application � Boar � g pp � abstaining. On this date, the <br />Board found that the request met the conditions set forth by the plat filed with the Lamar County <br />Clerk in May of 2013. <br />Appeal: Any interested person wishing to appeal this Board decision is required to file a petition <br />for Writ of Certiorari in a district court, county court or county court at law within ten (10) days <br />of the date this decision is filed in the Board's office consistent with section 211.011 of the Texas <br />Local Government Code. <br />In the Board's approval of the request, the following findings were adopted as the reasons for this <br />approval. They are as follows: <br />1. There is a unique condition of the property in common to other properties in the development. <br />2. There is a hardship identified with this request given the fact that the lot is being developed <br />consistent with other duplex dwellings adjacent to the subject property and in line with others <br />along the street. <br />3. The granting of the variance will not violate the spirit or the intent of the Zoning & Subdivision <br />Ordinances of the City and the original intent of the 25 ft. front yard setbacks established for <br />the Hilltop Subdivision. <br />4. The condition or feature which creates the need for the variance does result from the property <br />owner's actions, but is in keeping with building line conditions of the adjoining properties to <br />the North. <br />5. The variance by the applicant is not intended solely for personal convenience. <br />
