f a r ,3iEpr/ D Q <br />DECISION OF THE BOARD OF ADJUSTMENT, CITY OF PARIS, TEXAS <br />RE: Variance Request <br />William and Stephanie Bailey <br />4030 Sage Trail <br />Paris, Texas 75460 <br />ACTION REQUESTED: 17' Variance to 35' Build line indicated on Plat for a Carport only <br />The above -reference request was (granted denied / granted in part and denied in part) by the City <br />" ', in favor of <br />of Paris Zoning Board of Adjustment B ppd� "on 11/02/2021 by a vote of r_ <br />g J ( <br />the application and against the application with abstaining On this date, the <br />Board found that the request did not meet the conditions set forth by the plat filed with the Lamar <br />County Clerk in September of 1985. <br />Appeal: Any interested person wishing to appeal this Board decision is required to file a petition <br />for Writ of Certiorari in a district court, county court or county court at law within ten (10) days <br />of the date this decision is filed in the Board's office consistent with section 211.011 of the Texas <br />Local Government Code. <br />In the Board's denial of the request, the following findings were adopted as the reasons for this <br />denial. They are as follows: <br />1. There are no unique conditions or features of the property not generally in common to other <br />properties in the development. <br />2. There is no hardship identified with this request given the fact that the lot is developed <br />consistent with other single-family dwelling in the immediate vicinity of the subject property. <br />3. The granting of the variance will violate the spirit or the intent of the Zoning & Subdivision <br />Ordinances of the City and the original intent of the 35 ft. front yard setbacks established for <br />the Westgate Addition. <br />4. The condition or feature which creates the need for the variance results from the property <br />owner's own intended actions. The need is self-imposed for additional garage space in the <br />front yard where parking is otherwise allowed without a structure in violation of required <br />setbacks. <br />5. The variance by the applicant is solely for personal convenience. <br />
