Item No. 11 <br />Memorandum <br />TO: Mayor, Mayor Pro -Tem & City Council <br />FROM: Andrew Mack, AICP Director Planning & Community Development <br />SUBJECT: Consideration of and action on the Final Plat of the Brown 294 Addition, Lot 1, Block <br />A, LCAD Property ID 18507, located at 426 NE 30th. <br />MTG. DATE: November 8, 2021 <br />BACKGROUND <br />At its meeting initially held on September 7, 2021, the Commission approved a Preliminary Plat for the Brown <br />294 Addition. The applicant has now requested approval for the final plat. The subject property involves the <br />undeveloped land area located at 426 NE 30' St. & Pine Mill for the new construction of a hair salon. The <br />subject property was recently rezoned to Neighborhood Service (NS). The site contains .688 acres. All <br />minimum lot size requirements for the plat are met and all setbacks can also be met. The P&Z recommended <br />conditional approval to the City Council at their meeting held on 11/1/21. <br />The approval conditions of the preliminary plat were as follows: <br />1. The existing utilities adjacent to the site shall be added to the preliminary plat. <br />2. A total of five (5') shall be dedicated as street right-of-way (ROW) along the entire frontage of 3011' <br />St. NE upon the final plat. <br />3. A new fire hydrant shall be installed along the Pine Mill frontage prior to issuance of a Certificate of <br />Occupancy (CO) for the new building constructed on the property. <br />Upon submission of the final plat, it was determined that condition number 2 was not satisfied by including <br />the additional required 5 feet of ROW dedication along 30' St. The additional item yet to be addressed by the <br />business owner is condition number 3 having to do with the new fire hydrant. Given the fact that it is a <br />relatively easy thing for the surveyor and contractor to do at plat recording and building permit application <br />stages, staff is comfortable with recommending a conditional approval of the final plat. The ROW dedication <br />will have to be added to the final plat prior to release for recording and issuance of a building permit. The new <br />fire hydrant can be addressed at the time of building permit and site plan approval. <br />RECOMMENDATION <br />Staff and the P&Z recommends approval of the Final Plat, subject to the following conditions: <br />1. A total of five (5') shall be dedicated as street right-of-way (ROW) along the entire frontage of 301 <br />St. NE upon the final plat prior to release for recording and issuance of a building permt. <br />2. A new fire hydrant shall be installed along the Pine Mill frontage prior to issuance of a Certificate of <br />Occupancy (CO) for the new building constructed on the property. <br />
