It is important to note that the City of Paris is subject to a 1976 Federal <br />Court Order that addressed racial inequality in the City of Paris' election <br />process. This specific order is still in effect and is unique to Paris; <br />consequently City Staff sought outside legal counsel (Monte Akers and Tad <br />Dunn at the Messer law firm) for a second opinion as to whether the city <br />would have to get court approval in order to change the current process. <br />This has taken some time, and we did not receive an opinion until November <br />30ffi, after the CRC had completed its work. Therefore, the CRC was <br />advised of the work we had to do to determine what is allowed, but <br />encouraged them to make their proposal to the City Council. Outside <br />counsel has opined, and Stephanie concurs, that given the express language <br />of the order, the city cannot change the method for selecting the mayor <br />without first seeking approval from the U.S. District Court, Eastern District <br />of Texas. Staff will be prepared to discuss the ramifications of this issue at <br />the December 13, 2021 meeting. <br />b. Attendance requirement <br />c. Working with Bond Legal Counsel, a complete re -write to reflect more modern <br />practices and streamline those practices to address long term indebtedness laws in <br />the State of Texas. <br />7. Article VII <br />a. Cleanup language to reflect current practices and/or remove outdated language for <br />1) duties of the Finance Director and 2) surety coverage for employees. <br />
